Article 46 of the Regulations Respecting the Laws and Customs of War on Land Annexed to Hague Convention No. IV of 1907 states that “family honour and rights ... must be respected” by warring parties.
وتقول المادة ٦٤ من اﻷنظمة المتعلقة بقوانين وأعراف الحرب البرية الملحقة باتفاقية لاهاي الرابعة لعام ٧٠٩١ إن " شرف اﻷسرة وحقوقها ينبغي احترامهما " من جانب اﻷطراف المتحاربة.

The so called “Martens clause” is included in the preambular part of the Hague Convention No. IV of 18 October 1907 concerning the Laws and Customs of War on Land.

This is so because " the right of belligerents to adopt means of injuring the enemy is not unlimited " as stated in Article 22 of the 1907 Hague Regulations relating to the laws and customs of War on Land.

The Court would likewise refer, in relation to these principles, to the Martens Clause, which was first included in the Hague Convention II with Respect to the Laws and Customs of War on Land of 1899 and which has proved to be an effective means of addressing the rapid evolution of military technology.

As the Court noted, customary law concerning the conduct of military operations derives mainly from the annex to the Hague Convention IV of 18 October 1907 respecting the Laws and Customs of War on Land.
