وقد نبهت أسرة يحيى كرومي السلطات المختصة مراراً وتكراراً إلى اختفاء الشخص المعني، غير أن الدولة الطرف لم تأذن بفتح تحقيق شامل ودقيق في الموضوع رغم أن الأمر ينطوي على مزاعم خطيرة تتعلق بحالة اختفاء قسري.

In the present case, the Committee notes that the State party has not furnished any explanation concerning the fate of Yahia Kroumi, despite the multiple requests addressed by the author to the State party.

In view of the allegations concerning the incommunicado detention of Yahia Kroumi under conditions that caused the death of many persons in a single night, and in the absence of information from the State party in that regard, the Committee finds a violation of article 10, paragraph 1, of the Covenant.
وبالنظر إلى أن الادعاءات التي مفادها أن يحيى كرومي أُودع الحبس الانفرادي في ظروف أدت إلى وفاة عدد كبير من المحتجزين في ليلة واحدة، وفي غياب أية معلومات من جانب الدولة الطرف بهذا الخصوص، تخلص اللجنة إلى أن المادة 10 (الفقرة 1) من العهد قد انتُهكت().

The Committee concludes that the entry of officials into the family home of Yahia Kroumi in such circumstances constitutes unlawful interference with his home, in violation of article 17 of the Covenant.
وتخلص اللجنة إلى أن دخول موظفي الدولة إلى منزل يحيى كرومي في الظروف التي بينها صاحب البلاغ يشكل تدخُّلاً غير قانوني في شؤون بيته، ما يمثل انتهاكاً للمادة 17 من العهد().

The author maintains, moreover, that when an enforced disappearance lasts for a long period, as is the case of that of Yahia Kroumi, who disappeared more than 20 years ago, the disappearance in itself constitutes a violation of the right to life guaranteed by article 6 (para. 1) of the Covenant.

277. Furthermore, the Special Rapporteur requested the Government of Israel to provide him with information regarding the alleged summary execution on 5 January 1996 of Yahia Ayyash, suspected of involvement in several suicide bombings, including the explosion of a bus in central Tel Aviv, in 1995. Reportedly, an explosive device had been implanted in his mobile telephone and was detonated whilst he was using it.
