1. Each State Party shall make the commission of an offence established in accordance with this Convention liable to sanctions that take into account the gravity of that offence.
1- على كل دولة طرف أن تجعل ارتكاب أي فعـل مجرّم وفقا لهذه الاتفاقية خاضعا لجزاءات تُراعى فيها خطورة ذلك الجرم.

Knowledge, intent or purpose required as an element of an offence established in accordance with this Convention may be inferred from objective factual circumstances.
يمكن الاستدلال من الملابسات الوقائعية الموضوعية على توافر عنصر العلم أو النية أو الغرض بصفته ركنا لفعل مجرّم وفقا لهذه الاتفاقية.

1. Each State Party shall make the commission of an offence established in accordance with this Convention liable to sanctions that take into account the gravity of that offence.
1- تجعل كل دولة طرف ارتكاب فعـل مجرّم وفقا لهذه الاتفاقية خاضعا لعقوبات تُراعى فيها جسامة ذلك الجرم.

ألف- الاستعاضة عن عبارة " سلوك مجرّم وفقا لهذه الاتفاقية " بعبارة " فعل مجرّم وفقا لهذه الاتفاقية " باء-

يمكن الاستدلال من الملابسات الوقائعية الموضوعية على العلم أو النية أو الغرض بصفتها من عناصر فعل مجرّم وفقا لهذه الاتفاقية.

1. Each State Party shall make the commission of an offence established in accordance with this Convention liable to sanctions that take into account the gravity of that offence.
1- على كل دولة طرف أن تجعل ارتكاب أي فعـل مجرّم وفقا لهذه الاتفاقية خاضعا لعقوبات تُراعى فيها جسامة ذلك الجرم.

1. Each State Party shall adopt such legislative and other measures as may be necessary to establish as a criminal offence, in accordance with its domestic law, participation in any capacity such as an accomplice, assistant or instigator in an offence established in accordance with this Convention.
1- تعتمد كل دولة طرف ما قد يلزم من تدابير تشريعية وتدابير أخرى لكي تجرّم، وفقا لقانونها الداخلي، المشاركة بأي صفة، كطرف متواطئ أو مساعد أو محرض مثلا، في فعل مجرّم وفقا لهذه الاتفاقية.

2. Each State Party may adopt such legislative and other measures as may be necessary to establish as a criminal offence, in accordance with its domestic law, any attempt to commit an offence established in accordance with this Convention.
2- يجوز لكل دولة طرف أن تعتمد ما قد يلزم من تدابير تشريعية وتدابير أخرى لكي تجرّم، وفقا لقانونها الداخلي، أي شروع في ارتكاب فعل مجرّم وفقا لهذه الاتفاقية.

3. Each State Party may adopt such legislative and other measures as may be necessary to establish as a criminal offence, in accordance with its domestic law, the preparation for an offence established in accordance with this Convention.
3- تعتمد كل دولة طرف ما قد يلزم من تدابير تشريعية وتدابير أخرى لكي تجرّم، وفقا لقانونها الداخلي، الإعداد لارتكاب فعل مجرّم وفقا لهذه الاتفاقية.

2. Each State Party shall consider providing for the possibility, in appropriate cases, of mitigating punishment of an accused person who provides substantial cooperation in the investigation or prosecution of an offence established in accordance with this Convention.
2- تنظر كل دولة طرف في أن تتيح، في الحالات المناسبة، إمكانية تخفيف عقوبة المتهم الذي يقدم عونا كبيرا في عمليات التحقيق أو الملاحقة بشأن فعل مجرّم وفقا لهذه الاتفاقية.

3. Each State Party shall consider providing for the possibility, in accordance with fundamental principles of its domestic law, of granting immunity from prosecution to a person who provides substantial cooperation in the investigation or prosecution of an offence established in accordance with this Convention.
3- تنظر كل دولة طرف في إمكانية منح الحصانة من الملاحقة القضائية، وفقا للمبادئ الأساسية لقانونها الداخلي، لأي شخص يقدم عونا كبيرا في عمليات التحقيق أو الملاحقة بشأن فعل مجرّم وفقا لهذه الاتفاقية.

2. Each State Party shall consider encouraging its nationals and other persons with a habitual residence in its territory to report to the national investigating and prosecuting authorities the commission of an offence established in accordance with this Convention.
2- تنظر كل دولة طرف، في تشجيع رعاياها وغيرهم من الأشخاص الذين يوجد مكان إقامتهم المعتاد في اقليمها على إبلاغ السلطات الوطنية المعنية بالتحقيق والملاحقة عن ارتكاب فعل مجرّم وفقا لهذه الاتفاقية.

Criminal record Each State Party may adopt such legislative or other measures as may be necessary to take into consideration, under such terms as and for the purpose that it deems appropriate, any previous conviction in another State of an alleged offender for the purpose of using such information in criminal proceedings relating to an offence established in accordance with this Convention.
يجوز لكل دولة طرف أن تعتمد ما قد يلزم من تدابير تشريعية أو تدابير أخرى لكي يؤخذ بعين الاعتبار، حسبما تراه مناسبا من شروط وأغراض، أي حكم إدانة سبق أن صدر بحق الجاني المزعوم في دولة أخرى، بغية استخدام تلك المعلومات في اجراءات جنائية ذات صلة بفعل مجرّم وفقا لهذه الاتفاقية.

States Parties shall consider the possibility of transferring to one another proceedings for the prosecution of an offence established in accordance with this Convention in cases where such transfer is considered to be in the interests of the proper administration of justice, in particular in cases where several jurisdictions are involved, with a view to concentrating the prosecution.
تنظر الدول الأطراف في إمكانية نقل إجراءات الملاحقة المتعلقة بفعل مجرّم وفقا لهذه الاتفاقية إلى بعضها البعض، بهدف تركيز تلك الملاحقة، في الحالات التي يعتبر فيها ذلك النقل في صالح حسن سير العدالة، وخصوصا عندما يتعلق الأمر بعدة ولايات قضائية.
