45. The second ground relates to offences committed abroad by nationals or stateless persons having their habitual residence in the State party's territory.

Article 8. offences committed abroad in respect of legal assets enjoying universal protection
المادة 8 - الجرائم المرتكبة في الخارج ضد الأصول القانونية التي تتمتع بحماية عالمية

Article 8, paragraphs 2 and 3, of the Paraguayan Criminal Code provide the following restrictions in relation to the prosecution of offences committed abroad in respect of legal assets enjoying universal protection:
وتنص الفقرتان 2 و 3 من المادة 8 من القانون الجنائي في باراغواي على التقييدات التالية المتعلقة بالمحاكمة على الجرائم المرتكبة في الخارج ضد الأصول القانونية التي تتمتع بحماية عالمية:

27. The Committee regrets that the State party's jurisdiction over offences committed abroad is subject to the criterion of double criminality.
27- تعرب اللجنة عن أسفها لأن الولاية القضائية للدولة الطرف على الجرائم المرتكبة في الخارج تخضع لمعيار التجريم المزدوج.

In addition, article 146 of the Penal Code sanctions perpetrators who act for the purpose of making a profit or take part in associations for the purpose of committing offences or laundering money or securities representing the proceeds of offences committed abroad.

Nationals could be prosecuted only for offences committed abroad as permitted by existing treaties, in one case, and in another case on the basis of either a complaint by the victim or his or her legal successors or official denunciation by the authority of the country where the offence had been committed.

In the case of offences committed abroad such as piracy off the coast of Somalia, public prosecutors may be able to waive prosecution of the offence in accordance with the provisions of section 153c StPO.

32. The draft Penal Code, based on the provisions of the Penal Code currently applicable, extends the jurisdiction of the Togolese courts to offences committed abroad by any person, provided that the victim is of Togolese nationality at the time the offence was committed (article 10).
32 - ويوسع مشروع القانون الجنائي، الذي يستند إلى أحكام القانون الجنائي الساري، نطاق الولاية القضائية للمحاكم التوغولية ليشمل الجرائم التي يرتكبها في الخارج أي شخص، شريطة أن تكون الضحية حاملة للجنسية التوغولية وقت ارتكاب الجريمة (المادة 10).

In addition to the offences listed, section 7 of the German Criminal Code provides for the application of German criminal law to offences committed abroad, provided that the victim of the offence is a German national and that the offence is a punishable crime in the country where the offence was committed, or if the place where the offence was committed is not subject to criminal law enforcement.
