The Government should like to draw attention below to the main measures taken to create a culture of awareness of, and increase the penalties for the offences of torture and illtreatment:
تود الحكومة أن تبرز أهم الإجراءات المتخذة في سبيل نشر ثقافة التوعية وتشديد العقوبة ضد جرائم التعذيب وإساءة المعاملة:

This safeguard, which is a unique feature of the Egyptian Constitution, affords the right to prosecute and punish persons suspected of committing offences of torture after any length of time and to award compensation for the harm and suffering inflicted on the victim as a result of such offences.
وتوفر هذه الضمانة التي ينفرد بها الدستور المصري الحق في ملاحقة المتهم في جرائم التعذيب مهما طال الزمن وأن ينال عقابه عنها وتعويض الضحية عن الأضرار والآلام التي لحقته من جرائها.

The offences of torture and corporal punishment were punishable under articles 18 and 19 of the Constitution and articles 303, 309, 310 and 311 of the Criminal Code.

It is important that the bill bringing the offences of torture and enforced disappearance into line with the categories established by the international instruments which Paraguay has ratified should be approved.
وتجدر الإشارة إلى أن مشروع القانون الرامي إلى جعل تعريف جرائم التعذيب والاختفاء القسري منسجماً مع التعريف الذي يرد في الصكوك الدولية التي صدقت عليها باراغواي لا يزال لم يعتمد بعد.

The Government recognizes how important awareness of human rights in general and of the dangers of the offences of torture and ill-treatment in particular is in creating cultural awareness among society at large about the gravity of the offences of torture and ill-treatment.
كما تدرك الحكومة أهمية الجانب التوعوي المعني بالتعريف بحقوق الإنسان بشكل عام والتعريف بأخطار جرائم التعذيب وإساءة المعاملة بشكل خاص وذلك لخلق وعي ثقافي لدى المجتمع بشكل عام حول خطورة جرائم التعذيب وإساءة المعاملة.

This constitutional rule is an important safeguard of the principles of human rights and freedoms in Egypt and applies to offences of torture insofar as they are an encroachment on the rights and freedoms guaranteed by the Constitution, as stated by the legislature in article 259 of the Code of Criminal Procedure.

The State party should amend its Military Penal Code in order to make the offences of torture in the military punishable by appropriate penalties which take into account their grave nature, in accordance with article 4 of the Convention and the relevant jurisprudence by the Committee.
ينبغي للدولة الطرف أن تُعدّل قانونها الجنائي العسكري لكي تجعل من الممكن المعاقبة على جرائم التعذيب في إطار الخدمة العسكرية، من خلال النص على عقوبات مناسبة تراعي الطبيعة الخطيرة لهذه الأفعال، وفقاً لأحكام المادة 4 من الاتفاقية والسوابق القضائية ذات الصلة التي صدرت عن اللجنة.

In addition, the Legislature formally adopted the recommendations made in the Expert's preceding report and set about incorporating in current criminal law the offences of torture (Decree No. 58-95 of 10 August 1995) and extrajudicial execution and enforced disappearance (Decree No. 48-95 of 15 June 1995).
٣٦- وباﻹضافة إلى ذلك، فإن السلطة التشريعية قد اعتمدت رسميا التوصيات المقدمة في التقرير السابق للخبيرة وبدأت في تضمين القانون الجنائي الراهن جرائم التعذيب )المرسوم رقم ٨٥-٥٩ المؤرخ في ٠١ آب/أغسطس ٥٩٩١(، واﻹعدام بلا محاكمة والاختفاء القسري )المرسوم رقم ٨٤-٥٩ المؤرخ في ٥١ حزيران/يونيه ٥٩٩١.

(a) The new Penal Code (Act No. 599/2000), which defines the offences of torture, genocide, forced disappearance and forced displacement and states that due obedience will not be considered as justifying those offences;
(أ) قانون العقوبات الجديد (القانون رقم 599/2000) الذي يعرّف جرائم التعذيب والإبادة الجماعية وحالات الاختفاء القسري والتشريد، وينص على عدم اعتبار الطاعة الواجبة مبرراً لارتكاب تلك الجرائم؛

(b) The new Military Penal Code (Act No. 522/1999), which excludes the offences of torture, genocide and forced disappearance from the jurisdiction of the military criminal courts and regulates the principle of due obedience;

Amnesty International (AI) recommended that the State classify the offences of torture and enforced disappearance as separate offences in the category of crimes under international law contained in the Criminal Code.
وأوصت منظمة العفو الدولية بأن تعرّف الدولة جريمتي التعذيب والاختفاء القسري في القانون الجنائي بوصفهما جريمتين قائمتين بذاتهما، ضمن فئة الجرائم بموجب القانون الدولي(19).
