وتعلن المادة اﻷولى من ذلك الفصل من الدستور أن اﻹسلام هو الدين الرسمي للدولة.

484. The Islamic religion is regarded as the official religion of the State under the Constitution and Muslims represent the majority of the country.
485- ويعتبر الدين الإسلامي هو الدين الرسمي للدولة طبقاً للدستور ويشكل المسلمون الأغلبية.

The Government of the State of Kuwait declares that it does not consider itself bound by the provision contained in article 16, paragraph 1 (f), inasmuch as it conflicts with the provisions of the Islamic Shariah, Islam being the official religion of the State.
تعلن حكومة دولة الكويت أنها لا تعتبر نفسها ملتزمة بحكم الفقرة الفرعية ١ )و( من المادة ١٦ وذلك لتعارضها مع أحكام الشريعة اﻹسلامية التي هي الدين الرسمي للدولة.

72. The Government of the Republic of Iraq wishes to remind the Committee on the Rights of the Child that Iraq is a Muslim country, the official religion of the State being Islam. Consequently, the legislation in force does not permit the adoption system, which conflicts with the Islamic Shari'a. Iraqi law applies the system of child fostering instead of adoption.
٢٧- تذكر حكومة جمهورية العراق لجنة حقوق الطفل بأن العراق هو أحد البلدان اﻹسلامية وأن دين الدولة الرسمي هو اﻹسلام، لذا فإن القوانين المرعية لا تجيز )نظام التبني( لكونه يتعارض مع الشريعة اﻹسلامية ويستخدم القانون العراقي بدلا عن ذلك )نظام ضم الطفل(.

200. Iraq is a Muslim country and the official religion of the State is Islam. Consequently, legislation in force does not permit the adoption system, which conflicts with the Shariah. Iraqi law applies the system of child fostering instead of adoption. The Juvenile Welfare Act No. 76 (1983) deals with fostering (the placement of a child in the care of foster parents) in the following manner:
200- تذكر حكومة جمهورية العراق لجنة حقوق الطفل بأن العراق هو أحد البلدان الإسلامية وان دين الدولة الرسمي هو الإسلام، لذا فأن القوانين المرعية لا تجيز (نظام التبني) لكونه يتعارض مع الشريعة الإسلامية ويستخدم القانون العراقي بدلاً عن ذلك (نظام ضم الطفل)، ويعالج قانون رعاية الأحداث رقم 76 لسنة 1983 ما يتعلق بضم الطفل إلى أبوين يقومان برعايته وعلى النحو الأتي:

ECLJ noted that the Afghan Constitution makes Islam the official religion of the State and prohibits any law that contravenes the tenets of Islam.
29- لاحظ المركز الأوروبي للقانون والعدالة أن الدستور الأفغاني يجعل الإسلام الدين الرسمي للدولة ويحظر أي قانون يخالف مبادئ الدين الإسلامي(50).
