It is also concerned at the fact that the guidelines set out in the Manual on Effective Investigation and Documentation of Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment (the Istanbul Protocol, 1999) are not followed in investigations into cases of torture or ill-treatment (art. 10).
كما يساور اللجنة القلق لأن المبادئ التوجيهية المنصوص عليها في دليل التقصي والتوثيق الفعالين بشأن التعذيب وغيره من ضروب المعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة (بروتوكول اسطنبول، 1999)، لا تُتَّبع عند التحقيق في حالات التعذيب أو سوء المعاملة (المادة 10).

The SPT urges the Prosecutor-General to establish clear procedures as to how torture complaints should be investigated, in accordance with the Manual on Effective Investigation and Documentation of Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment (Istanbul Protocol).

(e) Ensure that the specialized medical-psychological examination of alleged cases of ill-treatment is carried out in line with the Manual on Effective Investigation and Documentation of Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment (Istanbul Protocol);
(ﻫ) ضمان أن تجري الفحوصات الطبية والنفسية المتخصصة في ما يزعم من حالات سوء المعاملة وفقاً للتوجيهات الواردة في دليل التقصي والتوثيق الفعّالين بشأن التعذيب وغيره من ضروب المعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة (بروتوكول اسطنبول)؛

The Committee recommends that the Manual on Effective Investigation and Documentation of Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment (Istanbul Protocol) become an integral part of the training provided to all personnel involved in the detention or imprisonment of persons, as well as to all personnel involved in the investigation and documentation of torture.
وتوصي اللجنة بجعل الدليل المتعلق بالتحقيق والتوثيق الفعالين بشأن التعذيب وغيره من ضروب المعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة (بروتوكول اسطنبول) جزءاً لا يتجزأ من التدريب المقدم لجميع الموظفين المعنيين باحتجاز الأشخاص أو سجنهم وكذا جميع الأفراد المعنيين بالتحقيق في التعذيب وتوثيقه.

The State party should also ensure that the Manual on Effective Investigation and Documentation of Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment (Istanbul Protocol) is a compulsory topic in the training of all professionals involved in the investigation and documentation of cases of torture and ill-treatment, and that it is widely publicized and applied.
وينبغي للدولة الطرف أيضاً أن تضمن إدراج دليل التقصي والوثائق الفعالين بشأن التعذيب وغيره من ضروب المعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة (بروتوكول اسطنبول) كموضوع إلزامي في برنامج تدريب جميع المهنيين المعنيين بالتحقيق في حالات التعذيب وسوء المعاملة وتوثيقها ونشره وتطبيقه على نطاق واسع.

It is also concerned that medical personnel who come into contact with persons deprived of their liberty, asylum-seekers and other aliens are not systematically trained in the provisions of the Manual on Effective Investigation and Documentation of Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment (the Istanbul Protocol) (art. 10).
ويساورها القلق أيضاً لكون العاملين في ميدان الطب الذين لهم اتصال بالأشخاص المحرومين من حريتهم وطالبي اللجوء وغيرهم من الأجانب لا يدربون بصورة منهجية على أحكام دليل التقصّي والتوثيق الفعالين للتعذيب وغيره من ضروب المعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة (بروتوكول اسطنبول) (المادة 10).
