At its third session, held in Nairobi from 31 October to 4 November 2011, the intergovernmental negotiating committee to prepare a global legally binding instrument on mercury requested the co-chairs of the contact group on emissions and releases established at that session, with the support of the secretariat, to develop an approach to possible elements of articles 10 and 11 of the legally binding instrument.

I have based my proposed text for Articles 10 and 11 on the material set out in the report prepared by the co-chair of the contact group on emissions and releases established at our fourth session on the work of that group (UNEP(DTIE)/Hg/INC.4/8, annex II).
