In this regard, the Committee wishes to reiterate that the prohibition of all ideas based on racial superiority or hatred is compatible with the right to freedom of opinion and expression, given that the exercise of this right carries special duties and responsibilities, including the obligation not to disseminate racist ideas.

٢٧٦ - يعرب عن قلق شديد إزاء غياب أحكام تشريعية تصنف نشر اﻷفكار، التي تقوم على التفوق العنصري أو الكراهية العنصرية وأعمال العنف أو التحريض على العنف ضد أي عرق أو أي جماعة من اﻷشخاص من لون أو أصل إثني آخر، وتقديم المساعدة للنشاطات العنصرية، جريمة يعاقب عليها القانون، وفق ما تقضي به المادة ٤.

3- إعلان كل نشر لأفكار تقوم على التفوق العنصري أو الكراهية العنصرية وكل تحريض على التمييز العنصري ضد أي شخص أو جماعة جريمةً يعاقب عليها القانون؛

It is only by implementing this wide array of actions that States will ensure that the dissemination of ideas based on racial superiority or hatred, incitement to racial discrimination, as well as acts of violence or incitement to such acts against a specific group of persons, are eliminated in the long term.
ولن تستطيع الدول كفالة القضاء في الأجل الطويل على الأفكار القائمة على التفوق العنصري أو الكراهية العنصرية والتحريض على التمييز العنصري، علاوة على أعمال العنف والتحريض على ارتكابها ضد مجموعة معينة من الأفراد، إلاّ إذا طبّقت هذه التشكيلة الواسعة من الإجراءات.

For this reason, application of the principle of expediency to the " dissemination of ideas based on racial superiority or hatred " does not contradict General Recommendation 15.

117. Sanctions are also provided for anyone who disseminates ideas based on racial superiority or hatred or anyone who commits acts of violence or incites others to commit them against any race or group of persons of a different colour or ethnic origin.
117- ويعاقب أيضا " كل من ينشر أفكارا قائمة على التفوق العرقي أو الكراهية العرقية أو يرتكب أفعال العنف أو يحرض على ارتكابها ضد أي عرق أو مجموعة أشخاص من لون أو أصل عرقي آخر " .

(أ) اعتبار كل نشر للأفكار القائمة على التفوق العرقي أو الكراهية العرقية والتحريض على التمييز العنصري وجميع أعمال العنف أو التحريض على ارتكاب هذه الأعمال ضد أي عرق أو أية مجموعة أشخاص من لون أو أصل عرقي آخر وتوفير أي مساعدة لأنشطة ذات طابع عنصري، بما في ذلك تمويلها، جريمة يعاقب عليها القانون؛

(c) To declare as an offence punishable by law all dissemination of ideas based on racial superiority or hatred, and incitement to racial discrimination, as well as all acts of violence or incitement to such acts against any race or group of persons of another colour or ethnic origin, and also the provision of any assistance to racist activities, including the financing thereof;
(ج) اعتبار نشر الأفكار القائمة على التفوق العرقي أو الكراهية العرقية والتحريض على التمييز العنصري وجميع أعمال العنف أو التحريض على ارتكاب هذه الأعمال ضد أي عرق أو أية مجموعة أشخاص من لون أو أصل عرقي آخر، وكذلك توفير أي مساعدة لأنشطة ذات طابع عنصري بما في ذلك تمويلها، جرائم يعاقب عليها القانون؛

On the contrary, political leaders and political parties have an important responsibility to explicitly and strongly condemn all political messages that disseminate ideas based on racial superiority or hatred and that incite racial discrimination or xenophobia.
وعلى العكس من ذلك، يضطلع الزعماء السياسيون والأحزاب السياسية بمسؤولية هامة عن التنديد صراحة وبقوة بجميع الخطابات السياسية التي تبث الأفكار القائمة على التفوق أو العداء العنصري والتي تحرض على التمييز العنصري أو كره الأجانب.

This statement, according to Iran, is consistent with article 4 (b) of the International Convention on the Elimination of All Forms of Racial Discrimination, which, Iran states, places " an obligation upon states to be vigilant and proceed against organizations that disseminate ideas based on racial superiority or hatred, acts of violence or incitements to such acts " .
وترى إيران أن هذا الكلام يتفق والمادة 4 (ب) من الاتفاقية الدولية للقضاء على جميع أشكال التمييز العنصري التي تذكر إيران أنها تفرض " على الدول التزاما بأن تكون يقظة وأن تتخذ الإجراءات اللازمة ضد المنظمات التي تنشر أفكارا تقوم على الاستعلاء العنصري أو الكراهية العنصرية وضد مرتكبي أعمال العنف المحرضين على هذه الأعمال " .
