The Republic of Lithuania Law on the Legal Status of Aliens was adopted on 29 April 2004 and came into force on 30 April 2004.

Of special significance is the proposed amendment to the Law of the Republic of Lithuania on the Legal Status of Aliens.

Article 3(2) of the Law of the Republic of Lithuania on the Legal Status of Aliens provides that aliens in the Republic of Lithuania shall be equal before the law without distinction as to sex, race, citizenship, language, origin, social status, religion, beliefs or views.
215- وتنص المادة 3 (2) من قانون جمهورية ليتوانيا بشأن الوضع القانوني للأجانب على مساواة الإجانب في جمهورية ليتوانيا أمام القانون دون أي تمييز فيما يتعلق بنوع الجنس أو العِرق أو الجنسية أو اللغة أو الأصل أو الوضع الاجتماعي أو الديانة أو المعتقدات أو الآراء.

Prior to the adoption of the new law, issues relating to the legal status and asylum of aliens were regulated by two separate laws: the Republic of Lithuania Law on Refugee Status and the Republic of Lithuania Law on the Legal Status of Aliens.

(8) The Committee welcomes the information provided by the delegation that the Law on the Legal Status of Aliens (Aliens Law) has been amended in November 2006 and that asylum-seekers are now exempt from detention, even in cases where they enter or stay illegally in the State party.

UNHCR recommended that Lithuania review and amend the Law on the Legal Status of Aliens to address issues related to family unity.

The Law on the Legal Status of Aliens (2008) provided for the Foreigners' Registration Centre to serve as the only facility for all asylum-seekers during the processing of asylum claims.

30. The Government of Lithuania reported that article 3 (2) of the Law on the Legal Status of Aliens of the Republic of Lithuania (Official Gazette, 2004, No. 73-2539) confirmed the principle that non-nationals were equal before the law, irrespective of their sex, race, nationality, language, origin, social status, religion, convictions or views.

32. Amendments to the Law on the Legal Status of Aliens had been drafted in order to implement directive 2008/115/EC of the European Parliament and of the Council of 16 December 2008, on common standards and procedures in member States for returning illegally staying third-country nationals (Official Journal of the European Union L 348, 24.12.2008, pp. 98-107).
32 - وقد تمت صياغة تعديلات لإدخالها على القانون المتعلق بالوضع القانوني للأجانب وذلك بقصد تنفيذ التوجيه 2008/115/EC للبرلمان الأوروبي وللمجلس الأوروبي المؤرخ 16 كانون الأول/ديسمبر 2008 بشأن المعايير والإجراءات الموحدة في الدول الأعضاء من أجل إعادة رعايا بلدان ثالثة يقيمون بشكل غير قانوني (الجريدة الرسمية للاتحاد الأوروبي OJL348, 24. 21.2008، الصفحات 98-107).

According to the data of the Migration Department under the Ministry of the Interior, no public bodies of Lithuania have been requested so far to issue a temporary residence permit for an alien on the basis of Article 49 of the Law on the Legal Status of Aliens.

On 28 November 2006, the Law of the Republic of Lithuania on the Legal Status of Aliens (Valstybės žinios (Official Gazette) No 73-2539, 2004) was supplemented with Article 49, which regulates the issuance of a temporary residence permit to an alien who cooperates with a pre-trial investigation body or a court in combating trafficking in human beings or other crimes involving trafficking in human beings.
73 - وفي 28 تشرين الثاني/نوفمبر 2006، تم تكميل قانون جمهورية ليتوانيا بشأن الوضع القانوني للأجانب (الجريدة الرسمية عدد 73-2539، 2004 بالمادة 49 التي تنظّم إصدار تصريح إقامة مؤقت للأجنبي الذي يتعاون مع هيئة تحقيق ما قبل المحاكمة، أو مع المحكمة في مكافحة الاتجار بالبشر أو غير ذلك من الجرائم التي تشمل الاتجار بالبشر.

38. The Committee is concerned at the absence of provisions in Law N41-IQ (1996) on the Legal Status of Aliens and stateless persons on family reunification, in particular, provisions concerning family members eligible for family reunification, clear procedures, timeframes and competent authorities for family reunification applications, as well as grounds for the refusal of a family reunification application.
38- يساور اللجنة القلق إزاء غياب أحكام في القانون رقم N41-IQ (1996) بشأن الوضع القانوني للأجانب وعديمي الجنسية فيما يخص لمّ شمل الأسر، لا سيما، الأحكام المتعلقة بأفراد الأسرة الذين يحق لهم الاستفادة من تدابير لمّ شمل الأسر، وإزاء أحكام واضحة، وآجال زمنية محددة وعدم تعيين سلطات مختصة من أجل تطبيق تدابير لمّ شمل الأسرة، وعدم تحديد أسباب رفض تطبيق تدابير لمّ شمل الأسر.
