At its current session, the Commission had before it an excerpt of the guide on the New York Convention for its consideration (A/CN.9/786).
138- وكان معروضا على اللجنة في دورتها الحالية مقتطفٌ من الدليل المتعلق باتفاقية نيويورك (A/CN.9/786) للنظر فيه.

The purpose of the database is to make the information gathered in the preparation of the Guide on the New York Convention publicly available, including details on the judicial interpretation of the Convention by States Parties.
والغرض من قاعدة البيانات تلك هو جعل المعلومات التي جُمعت لإعداد الدليل المتعلق باتفاقية نيويورك متاحة لعامة الناس بما في ذلك معلومات مفصّلة عن كيفية تفسير تلك الاتفاقية تفسيراً قضائياً من جانب الدول الأطراف.

The Commission was further informed that, pursuant to its request at its thirty-fifth session, the initial drafts of the digest on the Model Arbitration Law had been prepared by its secretariat, which was also exploring the feasibility of preparing a digest of case law on the New York Convention.

Several contacts have been established with judicial training institutions (e.g., International Judicial Training Centre of the Republic of Korea; the Legal and Judicial Training Centre of Macau, China) to include and expand the inclusion of UNCITRAL texts in academic curricula, with particular emphasis on the New York Convention and the Model Law on Cross-Border Insolvency.

By way of background, the issue of providing guidance on the New York Convention has been on the agenda of the Commission since its very first sessions.

The UNCITRAL Guide on the New York Convention does not constitute an independent authority indicating the interpretation to be given to individual provisions but rather serves as a reference tool collating a wide range of decisions from a number of jurisdictions.
7- ولكنَّ دليل الأونسيترال بشأن اتفاقية نيويورك لا يشكِّل مرجعيةً مستقلةً في تبيان التفسير المراد الأخذ به بخصوص فرادى الأحكام، بل هو يصلح لاستخدامه أداة مرجعية تجمّع طائفة واسعة من القرارات المستمدَّة من عدد من الولايات القضائية.

The Commission recalled that it had been informed, at its forty-fourth and forty-fifth sessions, in 2011 and 2012, that the Secretariat was carrying out a project on the preparation of a guide on the New York Convention, in

The Commission further agreed that the guide should be entitled " UNCITRAL Secretariat Guide on the New York Convention " and requested the Secretariat to publish the guide, including electronically, in the six official languages of the United Nations.

27. Ms. Gross (Secretariat) informed the Commission that a website had been established in order to make publicly available the information gathered in preparation of the guide on the New York Convention on the Recognition and Enforcement of Foreign Arbitral Awards.

45. Mr. Adamov (Belarus) said that his delegation welcomed the Commission's approval of the draft convention on transparency in treaty-based investor-State arbitration and its work on the preparation of a practical guide on the New York Convention.
٤٥ - السيد أداموف (بيلاروس): قال إن وفد بلده يرحب بموافقة اللجنة على مشروع اتفاقية الشفافية في التحكيم التعاهدي بين المستثمرين والدول وبعملها الرامي إلى إعداد دليل عملي بشأن اتفاقية نيويورك.

One of these instruments, the website www.newyorkconvention1958.org, has been established in order to make the information gathered in preparation of the UNCITRAL Guide on the New York Convention publicly available.

It supplements the cases collected in the CLOUT (Case Law on UNCITRAL Texts) database and serves as a primary reference tool underlying the UNCITRAL Guide on the New York Convention.

At its forty-sixth session, the Commission will have before it excerpts of the guide on the New York Convention for its consideration (A/CN.9/786).

The database was set up in cooperation with Professors G. Bermann and E. Gaillard and their respective teams and includes material which is used in the preparation of the Guide on the New York Convention that will be submitted to the Commission at its forthcoming forty-sixth session (see A/CN.9/786).
