5. A request addressed to a State party under paragraph 1 of this rule shall include a statement of the fact that such a request does not imply that any decision has been reached on the question of admissibility.

4.8 On 6 September 2006 the State party replied on the merits, making the same observations as on the question of admissibility.

9.2 The authors consider that it is inadmissible at this stage for the State party to introduce an argument concerning the remedy of " associated prosecution " in light of the fact that the State party was given two earlier opportunities to comment on the question of admissibility, besides which this remedy would be costly and would not bring any effective relief.
9-2 ويرى مقدما البلاغ أنه من غير المقبول في هذه المرحلة أن تتقدم الدولة الطرف بزعم بشأن سبيل الانتصاف المتمثل في " المشاركة في تقديم الدعوى " على ضوء أن الدولة الطرف قد أُتيحت لها فرصتين سابقتين للتعليق على مسألة المقبولية بالإضافة إلى أن هذا السبيل من سُبل الانتصاف مكلف ولن يحقق أي إنصاف فعلي.
