It considers that when a person is arrested by the authorities, if there is subsequently no news on their fate and no investigation is carried out, this omission on the part of the authorities amounts to removing the disappeared person from the protection of the law.
وترى اللجنة أنه إذا ألقت السلطات القبض على شخص من الأشخاص ولم ترد أي معلومات عن مصيره ولم يُجر أي تحقيق، فإن تقصير السلطات هذا يعني حرمان المختفي من حماية القانون.

7. The International Committee of the Red Cross (ICRC) concluded that the right to truth is a norm of customary international law applicable in both international and noninternational armed conflict, according to which " each party to the conflict must take all feasible measures to account for persons reported missing as a result of armed conflict and must provide their family members with any information it has on their fate " .
