(6) According to the present article, three conditions are required for international responsibility to arise for a member State circumventing one of its international obligations.
6 - ووفقاً لهذه المادة، تلزم ثلاثة عناصر لنشوء المسؤولية الدولية لدولة عضو تلتف على أحد التزاماتها الدولية.

Thus, when an international organization requests its members to carry out a certain conduct, the fact that the organization circumvents one of its international obligations may be inferred from the circumstances.
وهكذا، فحين تطلب منظمة دولية من أعضائها التصرف على نحو معين، يمكن أن يستنتج ضمناً من الملابسات القائمة أن المنظمة تلتف على أحد التزاماتها الدولية.

(7) Paragraph 1 assumes that compliance with the binding decision of the international organization necessarily entails circumvention of one of its international obligations.
7) وتفترض الفقرة 1 أن الامتثال للقرار الملزم للمنظمة الدولية يستتبع بالضرورة الالتفاف على أحد التزاماتها الدولية.

This second condition would exclude responsibility for the event of an organization using its power of binding member States for circumventing one of its international obligations.
وهذا الشرط الثاني من شأنه أن يستبعد المسؤولية في حالة منظمة تستخدم سلطتها في إلزام الدول الأعضاء للتنصل من التزام من التزاماتها الدولية.

According to that article, an international organization incurs international responsibility when it circumvents one of its international obligations by adopting a decision binding a member State or international organization to commit an act that would be internationally wrongful if committed by the former organization.

8 - وتبحث الفقرة 2 الحالة التي تلتف فيها منظمة دولية على أحد التزاماتها الدولية بأن تأذن لدولة أو منظمة دولية عضو بارتكاب فعل معين.

(10) For international responsibility to arise, the first condition in paragraph 2 is that the international organization authorizes an act that would be wrongful for that organization and moreover would allow it to circumvent one of its international obligations.

(8) وتبحث الفقرة 2 الحالة التي تلتف فيها منظمة دولية على أحد التزاماتها الدولية بأن توصي دولة عضواً أو منظمة دولية أخرى بارتكاب فعل معين، أو بأن تأذن لدولة عضو أو منظمة دولية أخرى بارتكاب هذا الفعل.
