وتبيﱢن المادة ٨ بالتحديد أنه ينبغي للدول أن تتخذ، على الصعيد الوطني، جميع التدابير اللازمة ﻹعمال الحق في التنمية ويجب أن تضمن، في جملة أمور، تكافؤ الفرص للجميع في إمكانية وصولهم الى الموارد اﻷساسية والتعليم والخدمات الصحية والغذاء واﻹسكان والعمل والتوزيع العادل للدخل.

According to article 8, paragraph 1, States should undertake, at the national level, all necessary measures for the realization of the right to development and shall ensure, inter alia, equality of opportunity for all in their access to basic resources, education, health services, food, housing, employment and the fair distribution of income.

One is the lens of ethnicity and race: do certain racial, ethnic or other groups enjoy greater levels of human rights as a result of gaining access to higher levels of income? Another lens could be the important notion of equality of opportunity for all in their access to resources, which has been provided for in article 8 of the Declaration on the Right to Development.

Section 29 of the Constitution allows women and men to " freely engage in economic activity, to work and pursue a livelihood anywhere in Malawi. " The Constitution further accords all persons with the right to enjoy development and demands that there should be equal opportunity for all in accessing basic resources, food, shelter employment, infrastructure, education, and health services.

56. Regarding measures to ensure the participation of discriminated and marginalized groups in public and political life, and the promotion of equality of opportunity for all in social and economic areas and combating poverty, the Special Rapporteur recommends, as provided for in the Durban Programme of Action, that States:
56- وفيما يتعلق بالتدابير الرامية إلى ضمان مشاركة الجماعات المهمشة والتي تعاني من التمييز في الحياة العامة والسياسية، وتعزيز تكافؤ الفرص للجميع في المجالات الاجتماعية والاقتصادية ومكافحة الفقر، يوصي المقرر الخاص الدول، كما هو منصوص عليه في برنامج عمل ديربان، بما يلي:

Furthermore, States have an obligation to undertake all necessary measures to fulfil the right to development, to ensure equality of opportunity for all in their access to basic resources and to undertake effective measures to ensure that women have an active role in the development process (ibid., art. 8.1).

The European Union also pointed out that poverty is a broader concept than not having enough income and requires, as stated in article 8 of the United Nations Declaration on the Right to Development, " equality of opportunity for all in their access to basic resources, education, health services, food, housing, employment and the fair distribution of income " .
وأشار الاتحاد الأوروبي أيضاً إلى أن الفقر مفهوم أوسع نطاقاً من عدم كفاية الدخل ويتطلب، كما ورد ذلك في المادة 8 من الإعلان العالمي بشأن الحق في التنمية، " تكافؤ الفرص للجميع في إمكانية وصولهم إلى الموارد الأساسية والتعليم والخدمات الصحية والغذاء والإسكان والعمل والتوزيع العادل للدخل " .

At the same time, the general guidelines may emphasize the duty of States to ensure, " inter alia, equality of opportunity for all in their access to basic resources, education, health services, food, housing, employment and the fair distribution of income " (E/CN.4/1997/20, annex I, para. 32).

32. The revenues gained from these agreements should serve to fulfil the rights of the population, consistent with the duty of States to " ensure, inter alia, equality of opportunity for all in their access to basic resources, education, health services, food, housing, employment and the fair distribution of income " .

The government has sustained allocation of resources to the education sector, to ensure that education and training embrace equity issues, such as equal opportunity for all in access, retention, transition and completion, and to eliminate gender and regional disparities at all levels of education by 2015.
وواصلت الحكومة تخصيص الموارد لقطاع التعليم لضمان أن يراعي التعليم والتدريب مسائل مثل تكافؤ الفرص للجميع في الوصول والبقاء والانتقال والإتمام()، والقضاء على أوجه التباين الجنسانية والإقليمية على جميع مستويات التعليم بحلول عام 2015().

71. Regarding the strengths and weaknesses of the Millennium Development Goals, one contributor shared the view of the task force, that poverty was a broader concept than not having enough income and required, as stated in article 8 of the Declaration on the Right to Development, " equality of opportunity for all in their access to basic resources, education, health services, food, housing, employment and the fair distribution of income " .
71- فيما يتعلق بمواطن القوة والضعف في الأهداف الإنمائية للألفية ذهب أحد التقارير إلى ما ذهبت إليه فرقة العمل من أن مفهوم الفقر أوسع من مجرد عدم الحصول على دخل كاف وهو يقتضي، كما ورد في المادة 8 من إعلان الحق في التنمية " تكافؤ الفرص للجميع في إمكانية وصولهم إلى الموارد الأساسية والتعليم والخدمات الصحية والغذاء والإسكان والعمل والتوزيع العادل للدخل " .

In addition, article 8 of the Declaration on the right to development (General Assembly resolution 41/128) stipulates that States should undertake " all necessary measures for the realization of the right to development and shall ensure, inter alia, equality of opportunity for all in their access to basic resources, education, health services, ... " .
وباﻹضافة الى ذلك، تنص المادة ٨ من إعلان الحق في التنمية )قرار الجمعية العامة ١٤/٨٢١( على أن تتخذ الدول " جميع التدابير اللازمة ﻹعمال الحق في التنمية ويجب أن تضمن، في جملة أمور، تكافؤ الفرص للجميع في امكانية وصولهم الى الموارد اﻷساسية والتعليم والخدمات الصحية ... " .

Measures required to realise the right to development must include " equality of opportunity for all in their access to basic resources, education, health services, food, shelter, employment and infrastructure. " Similarly, but more emphatically, section 30 stipulates that the State has " a responsibility to take measures to introduce reforms aimed at eradicating social injustices and inequalities. "
أما التدابير المطلوبة لإقرار الحق في التنمية فلا بد وأن تشمل " تكافؤ الفرصة للجميع من حيث سُبل وصولهم إلى الموارد الأساسية وإلى التعليم والخدمات الصحية والغذاء والمأوى والوظائف والهياكل الأساسية " (50) وبنفس القدر، ولكن بتأكيد أقوى، ينص الباب 30 على أن الدولة تتحمل " مسؤولية اتخاذ التدابير لإجراء الإصلاحات الرامية إلى استئصال شأفة المظالم وأوجه اللامساواة الاجتماعية(51) " .
