They could also provide examples of other requirements imposed by the procuring entities in practice that may intentionally or inadvertently distort or restrict participation by suppliers or contractors in the procurement proceedings, and should therefore be avoided.

(3) The procuring entity, when first soliciting the participation of suppliers or contractors in the procurement proceedings, shall specify:

" (4) The procuring entity shall use means of communication that are in common use by suppliers or contractors in the relevant context.

4. The procuring entity may use only those means of communication that are in common use by suppliers or contractors in the context of the particular procurement.
4- لا يجوز للجهة المشترية أن تستخدم سوى وسائل الاتصال الشائع استخدامها لدى الموَرِّدين أو المقاولين في سياق عملية الاشتراء المعنية.

5. The procuring entity shall make available to any person, upon request, its reasons for limiting the participation of suppliers or contractors in the procurement proceedings pursuant to this article.
5- تُتيحُ الجهةُ المشترية لأيِّ شخص، عند الطلب، الاطِّلاعَ على أسباب حدِّها من مشاركة الموَرِّدين أو المقاولين في إجراءات الاشتراء عملاً بهذه المادة.

(1) The procuring entity, in ascertaining the successful proposal, shall use the procedure provided for in article 42 (2) (a), 42 (2) (b), 43 or 44 that has been notified to suppliers or contractors in the request for proposals.
)١( على الجهة المشترية، في التحقق من الاقتراح الفائز، أن تتبع اﻹجراء المنصوص عليه في المادة ٤٢ )٢( )أ( أو ٤٢ )٢( )ب( أو ٤٣ أو ٤٤، الذي أبلغ الى الموردين أو المقاولين في طلب تقديم الاقتراحات.

3. The procuring entity, when first soliciting the participation of suppliers or contractors in the procurement proceedings, shall declare whether the participation of suppliers or contractors in the procurement proceedings is limited pursuant to this article and on which ground.
3- تُعلن الجهةُ المشترية، عند التماسها لأوَّل مرة مشاركة الموَرِّدين أو المقاولين في إجراءات الاشتراء، ما إذا كانت مشاركة الموَرِّدين أو المقاولين في إجراءات الاشتراء محدودة عملاً بهذه المادة، وأسباب ذلك الحد.

The Working Group requested the Secretariat to consider redrafting the broad reference to an " obstacle " to the participation of suppliers or contractors in the procurement proceedings in paragraph (2).

In such a case, the procuring entity, apart from reserving the possibility to amend form requirements or the means of communication when first soliciting the participation of suppliers or contractors in the procurement proceedings, will be required to ensure that the safeguards contained in article 7 (4) are complied with in any amended form and/or means of communications stipulated, and that all concerned are promptly notified about the change.
وفي هذه الحالة، سيكون على الجهة المشترية، بغضّ النظر عن احتفاظها بحق إجراء تعديلات على اشتراطات شكل أو وسائل الاتصال عندما تلتمس لأول مرة مشاركة مورِّدين أو مقاولين في إجراءات الاشتراء، أن تكفل الامتثال للضمانات الواردة في المادة 7 (4) في أيِّ شكل اتصالات معدَّل و/أو وسيلة اتصالات معدَّلة مما هو منصوص عليه، وأن تكفل إبلاغ كل الجهات المعنية على وجه السرعة بذلك التغيير.
