(2) The solicitation documents shall call upon suppliers or contractors to submit, in the first stage of the two-stage tendering proceedings, initial tenders containing their proposals without a tender price.

106- واتَّفقت اللجنةُ على أن يكون نصُّ أحكام هذه الفقرة كالتالي: " ملخصاً للمعايير والإجراءات التي ستُستخدَم للتأكّد من مؤهّلات المورِّدين أو المقاولين، ولأيِّ أدلة مستندية أو معلومات أخرى يجب على المورِّدين أو المقاولين أن يقدِّموها لإثبات مؤهّلاتهم، بما يتوافق مع المادة 9 من هذا القانون. "

(e) The criteria and procedures to be used for ascertaining the qualifications of suppliers or contractors and any documentary evidence or other information that must be presented by suppliers or contractors to demonstrate their qualifications in conformity with article 9 of this Law;

(3) يجوز للجهة المشترية، رهناً بحق المورِّدين أو المقاولين في حماية ممتلكاتهم الفكرية أو أسرارهم التجارية، أن تشترط على المورِّدين أو المقاولين المشاركين في إجراءات الاشتراء أن يقدِّموا الأدلة المستندية أو المعلومات الأخرى المناسبة لكي تقتنع بأنهم مؤهّلون وفقاً للمعايير المشار إليها في الفقرة (2).

3. Subject to the right of suppliers or contractors to protect their intellectual property or trade secrets, the procuring entity may require suppliers or contractors participating in procurement proceedings to provide appropriate documentary evidence or other information to satisfy itself that the suppliers or contractors are qualified in accordance with the criteria referred to in paragraph 2 of this article.
3- يجوز للجهة المشترية، رهناً بحق الموَرِّدين أو المقاولين في حماية ممتلكاتهم الفكرية أو أسرارهم التجارية، أن تشترط على الموَرِّدين أو المقاولين المشاركين في إجراءات الاشتراء أن يقدِّموا الأدلة المستندية أو المعلومات الأخرى المناسبة لكي تقتنع بأنهم مؤهّلون وفقاً للمعايير المشار إليها في الفقرة 2 من هذه المادة.

(2) Subject to the right of suppliers or contractors to protect their intellectual property or trade secrets, the procuring entity may require suppliers or contractors participating in procurement proceedings to provide such appropriate documentary evidence or other information as it may deem useful to satisfy itself that the suppliers or contractors are qualified in accordance with the criteria referred to in paragraph (1) (b).
)٢( مع مراعاة حق الموردين أو المقاولين في حماية ملكيتهم الفكرية أو أسرارهم التجارية، يجوز للجهة المشترية أن تشترط على الموردين أو المقاولين المشتركين في اجراءات الاشتراء أن يقدموا من اﻷدلة المستندية أو المعلومات اﻷخرى المناسبة ما تراه مفيدا للتحقق من أن الموردين أو المقاولين مؤهلين وفقا للمعايير المشار إليها في الفقرة )١( )ب(.
