The use of evidence obtained otherwise in breach of human rights or domestic law generally renders the trial as unfair;
واستخدام الدليل المستمد بأية وسيلة أخرى تمثل انتهاكا لحقوق الإنسان أو القانون المحلي يؤدي عموما إلى اعتبار المحاكمة غير عادلة؛

(1) Whether the Convention is directly applicable in domestic law on ratification, or has been incorporated into the national Constitution or domestic law so as to be directly applicable;
إن كانت الاتفاقية منطبقة بشكل مباشر، في القوانين المحلية فور التصديق عليها أو إن كانت قد أدمجت في الدستور الوطني أو في القانون المحلي بحيث يمكن تطبيقها بصورة مباشرة؛

(1) Whether the Convention is directly applicable in domestic law on ratification, or has been incorporated into the national Constitution or domestic law so as to be directly applicable;

Article 11 provides that the said Law does not apply to offences committed in Iraq by persons enjoying immunity under international conventions, international law or domestic law.
نصَّت المادة 11 على أن " لا يسري هذا القانون على الجرائم التي تقع في العراق من الأشخاص المتمتعين بحصانة مقررة بمقتضى الاتفاقيات الدولية أو القانون الدولي أو القانون الداخلي " .

2. Nothing in this article shall preclude the trial and punishment of anyone for any act which, at the time it was committed, was criminal in accordance with international law or domestic law applicable in conformity with international law. "
" ٢ - ليس في هذه المادة ما يحول دون محاكمة أي شخص ومعاقبته عن أفعال كانت تعتبر، وقت ارتكابها، جريمة بمقتضى القانون الدولي أو القانون الوطني الواجب التطبيق طبقا للقانون الدولي " .

It follows that official regimes which practise terrorism assert the legality of their activities drawing on well-recognized claims of legitimacy based upon national or domestic law.
ويستتبع ذلك إدعاء الأنظمة الرسمية التي تمارس الإرهاب شرعية أنشطتها بالاعتماد على ادعاءات الشرعية المعترف بها تماما استنادا إلى القانون الوطني أو القانون المحلي.

5. Nothing in this Convention shall affect the application of international conventions providing for limitation of liability, or domestic law giving effect thereto, in the State where an arrest is effected.
5- ليس في هذه الاتفاقية ما يمس تطبيق الاتفاقيات الدولية التي تنص على الحد من المسؤولية، أو القانون المحلي الذي يدخلها حيز النفاذ، في الدولة التي وقع فيها الحجز.

114. Where UNCTAD provides technical assistance, it should refrain from promoting traditional investment protection agreements or their equivalent provisions in free trade agreements or domestic law.
114- وعندما يقدم الأونكتاد مساعدة تقنية، ينبغي أن يمتنع عن تشجيع اتفاقات حماية الاستثمار التقليدية أو ما يعادلها من أحكام في اتفاقات التجارة الحرة أو القانون المحلي.

69. The international responsibility of a State for its acts extended to all territories and persons subject to its jurisdiction or authority, whether such authority was exercised legally or illegally from the standpoint of public international law or domestic law.
٩٦- وأكد أن المسؤولية الدولية ﻷي دولة عن أفعالها تمتد لتشمل جميع اﻷراضي واﻷشخاص الخاضعين لولايتها أو لسلطتها، سواء أكانت هذه السلطة تمارس بشكل مشروع أم غير مشروع من وجهة نظر القانون الدولي العام أو القانون المحلي.

41. Article 11 makes provision for exceptions to this rule by stipulating that: " This Code is not applicable to offences committed in Iraq by persons enjoying statutory immunity under the terms of international treaties or international or domestic law. " The jurisdiction of Iraqi law is reaffirmed in the cases referred to in the following paragraphs of article 12:
41- ووضعت المادة استثناء على سريان قانون العقوبات بالنص على أن " لا يسري هذا القانون على الجرائم التي تقع في العراق من الأشخاص المتمتعين بحصانة مقررة بمقتضى الاتفاقيات الدولية أو القانون الدولي أو القانون الداخلي " لكن المادة 12 عادت لتمنح القانون العراقي اختصاصاً جديداً بالنص على ما يلي:

Thus, the absence of an express provision on universal jurisdiction, would not prevent the courts from it on that basis, since, in accordance with the constitutional framework, treaties and customary international law incorporating universal jurisdiction had the same standing within the particular jurisdiction as the constitution or domestic law (e.g., Republic of Korea, Peru, Tunisia).
وهكذا، فإن غياب نص صريح على الولاية القضائية العالمية لا يمنع المحاكم من إقامتها على ذلك الأساس، لأن المعاهدات والقانون الدولي العرفي المتضمنين للولاية القضائية العالمية لهما، وفقا للإطار الدستوري، منزلة مماثلة لمنزلة الدستور أو القانون الداخلي ضمن الولاية القضائية المعنية (مثال جمهورية كوريا وبيرو تونس).

(b) The detention facilities operated by United States-led Coalition forces in Bagram, Kandahar, and in field " fire bases " unregulated by a Status of Forces Agreement (SOFA) (at least none that is publicly known or disclosed by any public official), where an estimated 300-400 detainees are held without legal process under international humanitarian law or domestic law.
(ب) مرافق الاحتجاز التي تديرها قوات التحالف بقيادة الولايات المتحدة في بغرام وقندهار وفي الميدان (قواعد انطلاق القوات) والتي لا تخضع لأي اتفاق لمركز القوات (أو بالأحــرى لأي اتفــاق علني أو مصرح به من لــدن أي مســؤول عــام)، حيث يُحتجــز ما يتراوح عدده بين 300 و 400 شخص دون اتباع الإجراءات القانونية الواجبة في إطار القانون الإنساني الدولي أو القانون الوطني.
