46. The Rules did not deal with situations in which the address was not the correct address or in which a given representative of the recipient was not a proper representative; nor did they need to deal with such situations because, if a party claimed not to have received proper notice of arbitration proceedings, the matter could be resolved by the arbitral tribunal or the courts.
46 - وتابع المتحدث قائلا إن قواعد التحكيم لا تتطرق إلى الحالات التي يكون فيها العنوان غير صحيح أو التي يكون فيها ممثل المتلقي شخصا لا يستوفي الشروط، وهي لم تكن في حاجة إلى معالجة تلك الحالات؛ وسبب ذلك هو أنه إذا ادعى طرف أنه لم يستلم الإشعار بالتحكيم على النحو الواجب، فإن هيئة التحكيم أو المحاكم المختصة هي التي تبت في المسألة.
