4 - لا تسري الفقرة 3 على أي حمولة منقولة على متن السفن المشار إليها في الفقرة 2 كما لا تسري على أي حمولة تملكها دولة وتكون مستخدمة أو مزمعا استخدامها في الأغراض الحكومية غير التجارية دون غيرها.

(c) It has been established that the property is specifically in use or intended for use by the State for other than government non-commercial purposes and is in the territory of the State of the forum, provided that post-judgement measures of constraint may only be taken against property that has a connection with the entity against which the proceeding was directed.
(ج) إذا ثبت أن الدولة تستخدم هذه الممتلكات أو تعتزم استخدامها على وجــه التحديد لأغراض أخرى غير الأغراض الحكومية غير التجارية، وأنها موجودة في إقليم دولة المحكمة شريطة أن يقتصر جواز اتخاذ الإجراءات الجبرية اللاحقة لصدور الحكم على الممتلكات المتصلة بالكيان الموجهة الدعوى ضده.

" واذ يذكر أيضا بالتوصيات الواردة في برنامج العمل العالمي الذي اعتمدته الجمعية العامة، إبان دورتها الاستثنائية السابعة عشرة، بشأن التدابير التي يتعين اتخاذها لمكافحة اﻵثار الناجمة عن اﻷموال المتأتيــة من الاتجار غير المشروع بالمخــدرات أو المستخدمة فيه أو التي يقصد استخدامها فيه، ولمكافحة التدفقات المالية غير المشروعة واستخدام النظام المصرفي على نحو غير مشروع،

1. The following categories, in particular, of property of a State shall not be considered as property specifically in use or intended for use by the State for other than government non-commercial purposes under article 19, subparagraph (c):
