It added that, whilst Saint Lucia has exercised a de facto abolitionist position in the last 15 years, having not performed any executions, it is not presently in a position to move towards an express moratorium on the use of the death penalty, or its abolition.
وأضافت أن سانت لوسيا ألغت عقوبة الإعدام بحكم الواقع طيلة فترة الخمس عشرة سنة الماضية حيث إنها لم تنفذ أي حكم بالإعدام ولكنها ليست في وضع يسمح لها حالياً بإعلان وقف تطبيق عقوبة الإعدام أو إلغائها صراحة.

If the General Assembly did decide to discuss the issue, it should be assigned not to the Third Committee, but to the Sixth, since capital punishment - whether its application or its abolition - was fundamental to the legal system of States in various countries and should therefore be discussed by the Committee concerned with legal matters.

In a note verbale addressed to the Secretary-General dated 11 January 2008, the Permanent Missions of 58 Member States to the United Nations in New York expressed, their " persistent objection to any attempt to impose a moratorium on the use of the death penalty or its abolition in contravention to existing stipulations under international law " .

Saint Lucia stated that the death penalty is reserved for the most heinous crimes and added that it is not currently in a position to move from a de facto to an express moratorium on the death penalty, or its abolition (A/HRC/17/6).

وفي مذكرة شفوية وُجّهت إلى الأمين العام بتاريخ 12 شباط/فبراير 2009، أعربت البعثات الدائمة لثلاث وخمسين دولة عضواً في الأمم المتحدة، ضمن ما أعربت عنه، عن " مواصلة اعتراضها على أي مسعى لفرض وقف تطبيق عقوبة الإعدام أو إلغائها بما يتنافى والأحكام القائمة التي ينص عليها القانون الدولي " (انظر A/63/716).

29. On 10 February 2009, the permanent missions of 53 States Members of the United Nations submitted a note verbale referring to resolution 63/168, and placed on record that they were in persistent objection to any attempt to impose a moratorium on the application of the death penalty or its abolition in contravention to existing stipulations under international law.

19. In 2008, by means of a note verbale referring to General Assembly resolution 62/149, entitled " Moratorium on the use of the death penalty " , Comoros, among 58 countries, wished to place on record their objection to any attempt to impose a moratorium on the use of death penalty or its abolition.
19- في عام 2008، أرادت جزر القمر، في مذكرة شفوية أشير فيها إلى قرار الجمعية العامة 62/149، وتحمل عنوان " الوقف الاختياري لتطبيق عقوبة الإعدام " ، أن تسجل مع 58 بلداً آخر، اعتراضها على أي محاولة لفرض وقف اختياري لتطبيق عقوبة الإعدام أو لإلغائها(36).
