It should be pointed out that States parties have a legal obligation to refrain from imposing restrictions or limitations on transfers in a manner hampering the economic or technological development of States parties, or international cooperation on peaceful applications of biotechnology.

Therefore, States parties to the Treaty are called upon to refrain from imposing or maintaining any restrictions or limitations on the transfer of nuclear equipment, materials and technology to States parties with comprehensive safeguards agreements.

10. The Fourth Review Conference emphasised that States Parties should not use the provisions of the Convention to impose restrictions and/or limitations on transfers for purposes consistent with the objectives and provisions of the Convention of scientific knowledge, technology, equipment and materials. The Conference reiterates that the provisions of this Article should not be used in any way and under any circumstance to impose restrictions and/or limitations on the transfer for purposes consistent with the objectives and the provisions of the Convention of scientific knowledge, technology, equipment and materials under Article X.
1- يكرر المؤتمر أنه ينبغي ألا تستخدم أحكام هذه المادة بأية طريقة وفي أية ظروف لفرض قيود و/أو حدود على نقل المعارف العلمية والتكنولوجيا والمعدات والمواد المدرجة في المادة العاشرة لأغراض تتفق مع أهداف الاتفاقية ومقاصدها.

The Conference underscores that States Parties have a legal obligation to refrain from imposing restrictions or limitations on transfers that would hamper economic or technological development of States Parties or international cooperation for peaceful applications in the field of biotechnology.
8- ويؤكد المؤتمر أن على الدول الأطراف التزام قانوني بالامتناع عن فرض قيود أو حدود على عمليات النقل من شأنها إعاقة التنمية الاقتصادية أو التكنولوجية للدول الأطراف أو التعاون الدولي في التطبيقات السلمية المتصلة بميدان التكنولوجيا الأحيائية.

States Parties also reiterated that States Parties should not use the provisions of Article III to impose restrictions and/or limitations on transfers for purposes consistent with the objectives and provisions of the Convention of scientific knowledge, technology, equipment and materials under Article X.
وأكدت الدول الأطراف مجدداً أن على الدول الأطراف ألا تستخدم أحكام المادة الثالثة لفرض قيود و/أو حدود على عمليات نقل المعارف العلمية، والتكنولوجيا والمعدات والمواد بموجب المادة العاشرة لأغراض تتفق مع أهداف وأحكام الاتفاقية.

(a) Avoid imposing restrictions and/or limitations on transfers for purposes consistent with the objectives and provisions of the Convention of scientific knowledge, technology, equipment and materials under Article X;

20. The Second, Third and Fourth Review Conferences noted that the provisions of this Article should not be used to impose restrictions and/or limitations on the transfer for purposes consistent with the provisions of the Convention of scientific knowledge, technology, equipment and materials under Article X.
