٣٨ - نؤكد أن الدول لها، وفقا لميثاق الأمم المتحدة ومبادئ القانون الدولي، حق سيادي في استغلال مواردها تبعاً لسياساتها البيئية والإنمائية وعليها مسؤولية توجب كفالة ألا تُلحق الأنشطةُ المضطلع بها في إطار ولايتها أو تحت سيطرتها ضررا ببيئة دول أخرى أو مناطق تقع خارج نطاق ولايتها الوطنية.

(d) States have the responsibility to ensure that activities within their jurisdiction do not cause damage to the environment of other States or of areas beyond the limits of national jurisdiction;
(د) تقع على عاتق الدول مسؤولية ضمان ألا تسبب الأنشطة التي تدخل في نطاق ولايتها أضرارا لبيئة دول أخرى، أو لمناطق واقعة خارج حدود ولايتها الوطنية؛

Also cited were Principle 21 of the Stockholm Declaration of 1972 and Principle 2 of the Rio Declaration of 1992 which express the common conviction of the States concerned that they have a duty " to ensure that activities within their jurisdiction or control do not cause damage to the environment of other States or of areas beyond the limits of national jurisdiction " .
واستُشهد أيضاً بالمبدأ ٢١ من إعلان ستوكهولم لعام ١٩٧٢ والمبدأ ٢ من إعلان ريو لعام ١٩٩٢ اللذين يعبران عن الاعتقاد المشترك لدى الدول المعنية بأن عليها واجب " ضمان أن لا تسبب اﻷنشطة التي تدخل في نطاق ولايتها أو سيطرتها أضراراً لبيئة دولة أخرى أو لمناطق واقعة خارج حدود ولايتها الوطنية " .
