1. The manner, place and deadline for presenting applications to pre-qualify or for pre-selection shall be set out in the invitation to pre-qualify or for pre-selection and in the pre-qualification or pre-selection documents, as applicable.

It was noted that open tendering with prequalification or pre-selection might achieve the same purposes as restricted tendering in a more transparent manner.
وأُشير إلى أن المناقصة المفتوحة مع الإثبات المسبق للمؤهلات أو الاختيار المسبق يمكن أن تحقّق الأغراض نفسها المنشودة من المناقصة المحدودة بطريقة أكثر شفافية.

(a) Complaints as regards the terms of solicitation, pre-qualification or pre-selection or arising from the pre-qualification or pre-selection proceedings shall be submitted no later than the deadline for presenting submissions;

Unlike other systems, the Model Law gives this right only to suppliers and contractors (the term includes potential suppliers or contractors covered by the definition of article 2 [**hyperlink**], such as those excluded through pre-qualification or pre-selection), and not to members of the general public or subcontractors.
