٦١ - وينبغي للدول اﻷعضاء أن تتعهد بايلاء اﻷولوية لمشكلة المغالاة في استخدام التوقيف رهن المحاكمة وفي استخدامه كعقوبة ، اﻷمر الذي يفضي الى الاكتظاظ الحاد في السجون ، الى جانب الانتهاكات المستمرة لحقوق الانسان ، ويعيق أو يحول دون اعادة دمج اﻷشخاص الذين يقعون ضحايا لمثل هذه الحالات في المجتمع على نحو ايجابي .
