المادة ١٢ - رفض جميع العطاءات أو الاقتراحات أو العروض أو عروض اﻷسعار

The procuring entity shall upon request communicate to any supplier or contractor that submitted a tender, proposal, offer or quotation, the grounds for its rejection of all tenders, proposals, offers or quotations, but is not required to justify those grounds.
وعلى الجهة المشترية، عند الطلب، أن تبلغ أسباب رفضها جميع العطاءات أو الاقتراحات أو العروض أو عروض اﻷسعار ﻷي مورد أو مقاول قدم عطاء أو اقتراحا أو عرضا أو عرض أسعار، بيد أنها ليست ملزمة بتبرير تلك اﻷسباب.

(2) The procuring entity shall incur no liability, solely by virtue of its invoking paragraph (1) of this article, towards suppliers or contractors that have submitted tenders, proposals, offers or quotations.
)٢( لا تتحمل الجهة المشترية أية مسؤولية لمجرد تذرعها بالفقرة )١( من هذه المادة، تجاه الموردين أو المقاولين الذين قدموا عطاءات أو اقتراحات أو عروضا أو عروض أسعار.

(2) In all the other methods of procurement, the manner of entry into force of the procurement contract shall be notified to the suppliers or contractors at the time that proposals, offers or quotations are requested.

(e) A summary of the evaluation and comparison of tenders, proposals, offers or quotations, including the application of any margin of preference pursuant to articles 34 (4) (d) and 39 (2);
)ﻫ( ملخصا لتقييم العطاءات أو الاقتراحات أو العروض أو عروض اﻷسعار وللمقارنة بينها، بما في ذلك منح أي هامش تفضيل وفقا للمواد ٣٤ )٤( )د( و ٣٩ )٢(؛

(f) If all tenders, proposals, offers or quotations were rejected pursuant to article 12, a statement to that effect and the grounds therefor, in accordance with article 12 (1);

47. A proposal was made for the deletion of paragraph (2), which provided that the procuring entity should disclose the manner of entry into force of the procurement contract in the documents for solicitation of proposals, offers or quotations.

(4) The procuring entity shall evaluate the qualifications of suppliers or contractors in accordance with the qualification criteria and procedures set forth in the prequalification documents, if any, and in the solicitation documents or other documents for solicitation of proposals, offers or quotations.
)٤( تُقيﱢم الجهة المشترية أهلية الموردين أو المقاولين طبقا للمعايير والاجراءات المحددة في وثائق التأهيل، إن وجدت، وفي وثائق التماس العطاءات أو غيرها من وثائق التماس الاقتراحات أو العروض أو عروض اﻷسعار.

(b) Due regard shall be had for the use of standardized trade terms, where available, in formulating the terms and conditions of the procurement contract to be entered into as a result of the procurement proceedings and in formulating other relevant aspects of the prequalification documents, solicitation documents or other documents for solicitation of proposals, offers or quotations.
)ب( ينبغي إيلاء المراعاة الواجبة لاستخدام مصطلحات تجارية موحدة، حيثما كانت متاحة، في صياغة أحكام وشروط عقد الاشتراء المراد إبرامه نتيجة ﻹجراءات الاشتراء، وفي صياغة الجوانب اﻷخرى ذات الصلة من وثائق التأهيل ووثائق التماس العطاءات أوغيرها من وثائق التماس الاقتراحات أو العروض أو عروض اﻷسعار.

(3) (a) Standardized features, requirements, symbols and terminology relating to the technical and quality characteristics of the goods, construction or services to be procured shall be used, where available, in formulating any specifications, plans, drawings and designs to be included in the prequalification documents, solicitation documents or other documents for solicitation or proposals, offers or quotations;
)٣( )أ( تستخدم السمات والاشتراطات والرموز والمصطلحات الموحدة ذات الصلة بالخصائص التقنية والنوعية للسلع أو اﻹنشاءات أو الخدمات المراد اشتراؤها، حيثما كانت متاحة، في وضع المواصفات والخرائط والرسوم والتصاميم التي ستدرج في وثائق التأهيل أو غيرها من وثائق التماس العطاءات أو عروض اﻷسعار.

It was also agreed that the Guide should elaborate on the utility for the procuring entity to negotiate and request, when feasible and necessary, market data or costs clarifications, in order to avoid unreasonably priced proposals or quotations.
واتُّفق أيضا على أن يتوسّع الدليل في تناول مسألة الجدوى بالنسبة للجهة المشترية في أن تتفاوض وفي أن تطلب، عند الإمكان والضرورة، بيانات عن الأسواق أو إيضاحات عن التكاليف، تفاديا لعدم تلقّي اقتراحات أو عروض أسعار تنطوي على أسعار غير معقولة.

(3) Notice of the rejection of all tenders, proposals, offers or quotations shall be given promptly to all suppliers or contractors that submitted tenders, proposals, offers or quotations.
)٣( يرسل اﻹخطار برفض جميع العطاءات أو الاقتراحات أو العروض أو عروض اﻷسعار، على الفور، إلى جميع الموردين أو المقاولين الذين قدموا عطاءات أو اقتراحات أو عروضا أو عروض أسعار.
