65. Although a declaration to the effect that gross and massive violations of human rights perpetrated on the orders of Governments or sanctioned by them are international crimes would not solve these problems, it could facilitate their solution.

The Commission at its fifty—first session, in decision 1995/111, requested the Sub-Commission, bearing in mind the work of the other United Nations bodies on the issue, to reconsider its recommendation to appoint a Special Rapporteur to prepare a report on the recognition of gross and large—scale violations of human rights, perpetrated on the orders of Governments or sanctioned by them, as an international crime.

Following a short discussion, the Sub-Commission, in resolution 1993/30, expressed its appreciation to Mr. Chernichenko for that working paper and decided to recommend to the Commission on Human Rights his appointment as Special Rapporteur to prepare a report entitled “Recognition of gross and large—scale violations of human rights perpetrated on the orders of Governments or sanctioned by them as an international crime”.
