The respondent argued that the conditions for recognition were not fulfilled because the claimant had not supplied the original arbitration agreement but merely its photocopy.
واحتج المدَّعَى عليه بأنَّ شروط الاعتراف لم تُستوفَ لأنَّ المدَّعِي لم يقدِّم اتفاق التحكيم الأصلي وإنما صورة منه فقط.

The Court of Appeal also observed that the award creditor had not complied with the requirements of article IV as it had not provided the original arbitration agreement and a duly certified copy of the award.
كما لاحظت محكمة الاستئناف أنَّ الطرف الذي صدر قرار التحكيم لصالحه لم يمتثل إلى متطلبات المادة الرابعة حيث إنَّه لم يقدِّم اتِّفاق التحكيم الأصلي ونسخةً معتمدةً حسب الأصول من قرار التحكيم.

However, the Court noted that this does not relieve the claimant from its obligation to supply the original arbitration agreement or its duly certified copy under the New York Convention.

The court concluded that when the award was set aside, the parties were put in the position they were in at the time the dispute arose and were released from the original arbitration agreement.
وخلصت المحكمة إلى أنه عندما ألغي قرار التحكيم، أعيد الطرفان إلى الموقف الذي كانا فيه وقت حدوث النـزاع وتحررا من اتفاق التحكيم الأصلي.

The tribunal also found that the statements of the parties in the proceedings before the commercial court were not relevant, as they did not positively prove the respondent's intention to amend the original arbitration clause.
وخلصت المحكمة أيضا إلى أن البيانات التي أدلى بها الطرفان في الإجراءات أمام المحكمة التجارية ليست ذات صلة بالموضوع، لأنها لا تثبت إثباتاً قاطعاً نيّة المدّعى عليه تعديل شرط التحكيم الأصلي.

Other courts have granted enforcement despite the fact that the applicant had not provided a duly authenticated original award or the original arbitration agreement (or a duly certified copy thereof).

The Supreme Court noted that under Article IV(1)(b) NYC, as well as Article 105(2) of the Civil Procedure Act, the party applying for recognition and enforcement shall, at the time of the application, supply the original arbitration agreement or a duly certified copy thereof.

It was proposed that paragraph (2) of article 35 of the Arbitration Model Law be amended to omit the requirement to submit the original arbitration agreement, a duly certified copy or any translation thereof such that the provision would read: " The party relying on an award or applying for its enforcement shall supply the duly authenticated original award or a certified copy thereof.

The claimant filed an appeal to the Supreme Court, claiming that the Court of first instance had misapplied substantial law and stating that there was no obligation to supply the original arbitration agreement because, according to Article 461(5) of the Civil Procedure Act, an arbitration agreement had been concluded when the claimant had referred to it in the statement of claim and the respondent had not contradicted it.
واستأنف المدَّعِي أمام المحكمة العليا مدّعيا أنَّ المحكمة الابتدائية أساءت تطبيق القانون الجوهري ومشيرا إلى أنه لا يوجد التزام بتقديم اتفاق التحكيم الأصلي لأنَّ اتفاق التحكيم، وفقا للمادة 461 (5) من قانون الإجراءات المدنية، كان قد أُبرم عندما أشار إليه المدَّعِي في صحيفة الدعوى ولم يلقَ ذلك اعتراضا من المدَّعَى عليه.

Reported case law shows that some courts have insisted that the applicant provide all requisite documents in the form prescribed by article IV(1), whereas others have granted recognition and enforcement of an award despite the fact that the applicant had not provided the duly authenticated award or the original arbitration agreement (or duly certified copies thereof).
