1. Parties shall seek to settle any dispute between them concerning the interpretation or application of this Convention through negotiation or other peaceful means of their own choice.
1 - تسعى الأطراف إلى تسوية أي نزاع بينها يتعلق بتفسير أو تطبيق هذه الاتفاقية عن طريق التفاوض أو أي طرق سلمية أخرى تختارها بنفسها.

Article 27 of the Agreement provides that all disputes shall be settled by negotiation, inquiry, mediation, conciliation, arbitration, judicial settlement, resort to regional agencies or arrangements or other peaceful means chosen by the parties to the dispute.

The parties to a dispute which is likely to endanger the maintenance of international peace and security shall first seek a solution by negotiations, enquiry, mediation, conciliation, arbitration, judicial settlement, resort to regional agencies or arrangements, or other peaceful means of the parties’ choice.
وعلى اﻷطراف في نزاع قد يهدد الحفاظ على السلام واﻷمن الدوليين أن تسعى أولا إلى إيجاد حل من خلال المفاوضات والتحقيق والوساطة والتوفيق والتحكيم والتسوية القضائية أو اللجوء إلى الوكالات أو الترتيبات اﻹقليمية أو غيرها من الوسائل السلمية التي تختارها اﻷطراف.

They should be pursued in parallel with earnest efforts for the peaceful settlement of disputes in accordance with the Charter of the United Nations, which provides for a solution by negotiation, enquiry, mediation, conciliation, arbitration, judicial settlement, resort to regional agencies or arrangements or other peaceful means chosen by the parties concerned.
وينبغي القيام بها بموازاة جهود جادة من أجل تسوية النزاعات سلميا وفقا لميثاق الأمم المتحدة الذي ينص على التماس الحل عن طريق التفاوض، أو التحقيق، أو الوساطة، أو التوفيق، أو التحكيم، أو التسوية القضائية، أو اللجوء إلى الوكالات أو الترتيبات الإقليمية أو غيرها من الوسائل السلمية التي تختارها الأطراف.

Article 33, paragraph 1, of the Charter of the United Nations provides that the parties to any dispute shall first of all seek a peaceful solution by negotiation, enquiry, mediation, conciliation, arbitration, judicial settlement, resort to regional agencies or arrangements or other peaceful means of their choice.
وتنص الفقرة 1 من المادة 33 من ميثاق الأمم المتحدة على أنه يجب على أطراف أي نزاع أن يلتمسوا حله بادئ ذي بدء بطريق المفاوضة والتحقيق والوساطة والتوفيق والتحكيم والتسوية القضائية، وأن يلجأوا إلى الوكالات والتنظيمات الإقليمية أو غيرها من الوسائل السلمية التي يقع عليها اختيارها.

2. States Parties shall settle any dispute between them concerning the interpretation or application of this Treaty through negotiations, mediation, conciliation or other peaceful means of the Parties' mutual choice.
2 - تقوم الدول الأطراف بتسوية أي خلاف ينشأ بينها بشأن تفسير هذه المعاهدة أو تطبيقها عن طريق التفاوض أو الوساطة أو التوفيق أو غيرها من الوسائل السلمية التي تختارها الأطراف.

Jordan is of the view that conflicts should be resolved peacefully through negotiation, enquiry, mediation, conciliation, arbitration, judicial settlement, resort to regional agencies or arrangements or other peaceful means chosen by the parties.
ويشجع الأردن على حل النزاعات المسلحة عن طريق التفاوض أو التحقيق أو التوفيق أو التحكيم أو التسوية القضائية أو اللجوء إلى الوكالات أو الترتيبات الإقليمية أو غيرها من الوسائل السلمية التي تختارها الأطراف.

8 - تسوية جميع النـزاعات الدولية بالوسائل السلمية، مثل التفاوض والتوفيق والتحكيم أو التسوية القضائية، بالإضافة إلى الوسائل السلمية الأخرى التي تختارها الأطراف نفسها وفقا لميثاق الأمم المتحدة.

" Stressing that sanctions are an extreme measure, which should be adopted only when other peaceful means have been exhausted and only when the Security Council determines the existence of a threat to the peace, breach of the peace or act of aggression,
" وإذ تؤكد على أن تطبيق الجزاءات يعد إجراء استثنائيا لا يجوز اللجوء إليه إلا بعد استنفاد كافة الوسائل السلمية الأخرى وعندما يقرر مجلس الأمن وجود خطر يتهدد السلام أو وقوع انتهاك للسلام أو عمل من أعمال العدوان،

It was reiterated that the application of sanctions should be an extreme measure, which should be resorted to only after all other peaceful means of settling the dispute have been exhausted and only when the Security Council has determined the existence of a threat to peace, a breach of the peace or an act of aggression.
وجرى تأكيد ضرورة أن يكون فرض الجزاءات تدبيرا استثنائيا لا يتم اللجوء إليه إلا بعد استنفاد جميع الوسائل السلمية الأخرى لتسوية المنازعات وعندما يقرر مجلس الأمن وجود تهديد للسلم، أو خرق للسلم، أو حدوث عمل من أعمال العدوان.

In that perspective, the Government of Pakistan draws your attention to Article 33 of the Charter of the United Nations, which provides for resort to peaceful means for the resolution of differences and the maintenance of international peace and security through negotiation, mediation, conciliation, arbitration, enquiry, judicial settlement, resort to regional agencies or other peaceful means.
وتوجه حكومة باكستان عنايتكم في هذا الشأن إلى المادة 33 من ميثاق الأمم المتحدة التي تنص على اللجوء إلى الوسائل السلمية لحل الخلافات والحفاظ على السلام والأمن الدوليين من خلال المفاوضة والوساطة والتوفيق والتحكيم والتحقيق والتسوية القضائية واللجوء إلى الوكالات الإقليمية أو غير ذلك من الوسائل السلمية.

In any case where the question of compensation gives rise to a controversy, it shall be settled under the domestic law of the nationalizing State and by its tribunals, unless it is freely and mutually agreed by all States concerned that other peaceful means be sought on the basis of the sovereign equality of States and in accordance with the principle of free choice of means. "
وفي كل مرة تؤدي فيها مسألة التعويض الى إثارة خلاف، يجب أن يسوى الخلاف بمقتضى التشريع المحلي للدولة المؤممة ومن قبل محاكمها، إلا اذا اتفقت جميع الدول المعنية، اتفاقا حرا ومتبادلا، على التماس وسائل سلمية أخرى تقوم على تساوي الدول في السيادة وتتفق مع مبدأ حرية اختيار الوسائل.

Parties are to settle any dispute by negotiation or any other peaceful means agreed upon by them, which may include enquiry, mediation, conciliation, arbitration, judicial settlement, or resort to regional agencies or arrangements.

٥٣- ورأى بلد أنه يمكن اعتبار عملية المادة ٣١ جزءاً من المادة ٤١، نظراً ﻷن الفقرة ١ من المادة ٤١ تقضي بأن يسعى اﻷطراف إلى تسوية المنازعات " عن طريق التفاوض أو بأي طريقة سلمية أخرى يختارونها " .
