The existence of the general obligation of States to ensure that activities within their jurisdiction and control respect the environment of other States or of areas beyond national control is now part of the corpus of international law relating to the environment.
وإن وجود الالتزام العام للدول بكفالة أن تحترم الأنشطة المضطلع بها داخل ولايتها وإشرافها بيئة الدول الأخرى أو المناطق الواقعة تحت سيطرتها الوطنية هو الآن جزء من مجموعة مواد القانون الدولي المتصلة بالبيئة.

The most important provision of the Declaration is principle 21, which asserts that States have the responsibility to ensure that activities within their jurisdiction and control do not cause damage to the environment of other States or of areas beyond the limits of national jurisdiction.

The Meeting noted that under the London Convention States have the responsibility to ensure that activities within their jurisdiction or control do not cause damage to the environment of other States or of areas beyond the limits of national jurisdiction.47
وأشار الاجتماع إلى أنه بموجب اتفاقية لندن، تتحمل الدول مسؤولية كفالة ألا تلحق الأنشطة التي تتم داخل نطاق ولايتها القانونية أو تحت رقابتها ضررا بالبيئة في دول أخرى أو في مناطق خارجة عن حدود ولايتها الوطنية(47).

As long ago as 1972, Principle 21 of the Stockholm Declaration established that national sovereignty can no longer be asserted to justify actions that “cause damage to the environment of other States or of areas beyond (...) national jurisdiction.” (A/CONF.48/14/Rev.1, p. 5)
