Unlike article 26 of ICCPR, articles 3 and 2, paragraph 2, of ICESCR are not standalone provisions, but should be read in conjunction with each specific right guaranteed under Part III of the Covenant.

C. Part III of the Covenant

42. A comparison of Part III of the Covenant (arts. 6-27) with Guatemalan domestic legislation shows that there is consistency between the Covenant and the corresponding national legal provisions.

These rights are set out in Part III of the Covenant, articles 6 to 27, inclusive. [citation omitted.] As shown by the Committee's jurisprudence, there is no objection to a group of individuals, who claim to be commonly affected, to submit a communication about alleged breaches of these rights.

The Committee is of the view that the State party has within its power the ability to immediately implement the rights in Part II of the Covenant as required, and to meet, at the least, its core obligations for the progressive realization of the rights in Part III of the Covenant.
45- ترى اللجنة أن الدولة الطرف تملك من السلطة ما يمكنها من إنفاذ الحقوق الواردة في الجزء الثاني من العهد فوراً وعلى الوجه المطلوب، والوفاء على الأقل بالتزاماتها الأساسية من أجل الإعمال التدريجي للحقوق الواردة في الجزء الثالث من العهد.

Secondly, it specifies that articles 2 and 3 of the Covenant, which deal with non-discrimination and gender equality, " are not stand-alone provisions, but should be read in conjunction with each specific right guaranteed under Part III of the Covenant " .

7.5 With regard to the State party's claim that the communication is incompatible with the provisions of the Covenant, the Committee recalled that the Optional Protocol provides for a procedure under which individuals can claim that their rights set out in Part III of the Covenant, article 6 to 27 inclusive, have been violated.
