Regarding the nature of crimes for which a State could be held responsible, his delegation agreed with the concept elucidated in, but not limited to, draft article 19 of Part One of the draft articles.

5. Several delegations commented on the spirit in which the Commission should approach the distinction between delicts and wrongful acts characterized as crimes in article 19 of Part One of the draft articles.

The notion of an international crime, as defined in article 19 of Part One of the draft articles on State responsibility, should be reviewed by the Commission in the light of recent developments in the theory and practice of international law.

13. On the issue of attribution, consistency and symmetry of language in the provisions of chapter II of Part One of the draft articles were important.

In this context, it was also observed that the topics of diplomatic protection and State responsibility were linked in terms of reasoning: the State was responsible for any violation of international law which it had committed or had been attributed to it, as stated in Part One of the draft articles on State responsibility.

4. As expected, the seventh report of the Special Rapporteur had given rise to controversy because the proposals contained in it derived directly from decisions taken by the Commission at the time of the adoption of article 19 of Part One of the draft articles.
