1. This article regulates the procedures for soliciting participation in procurement proceedings involving an ERA as a phase.

Article 53. Procedures for soliciting participation in procurement proceedings involving an electronic reverse auction as a phase preceding the award of the procurement contract
المادة 53- القواعد الإجرائية لالتماس المشاركة في إجراءات الاشتراء التي تنطوي على مناقصة إلكترونية كمرحلة تسبق إرساء عقد الاشتراء

1. Suppliers or contractors shall be permitted to participate in procurement proceedings without regard to nationality, except where the procuring entity decides to limit participation in procurement proceedings on the basis of nationality on grounds specified in the procurement regulations or other provisions of law of this State.
1- يُسمح للموَرِّدين أو المقاولين بالمشاركة في إجراءات الاشتراء بصرف النظر عن جنسياتهم، باستثناء الحالات التي تقرّر فيها الجهةُ المشترية أن تحدّ من المشاركة في إجراءات الاشتراء على أساس الجنسية، لأسباب محدَّدة في لوائح الاشتراء أو في أحكام أخرى من قانون هذه الدولة.

In cases where no limitation is imposed on participation in procurement proceedings on the basis of nationality, the procuring entity has also to assess the impact of specified means on access to procurement by foreign suppliers or contractors.
وفي الحالات التي لا تفرض فيها قيود على المشاركة في إجراءات الاشتراء على أساس الجنسية، يجب على الجهة المشترية أيضا أن تُقيِّم تأثير الوسائل المحدّدة على إمكانية مشاركة المورّدين أو المقاولين الأجانب في عملية الاشتراء.

2. As noted in the Guide, a decision to impose a limitation on participation in procurement proceedings may be taken in different situations.
2- وكما هو ملاحَظ في الدليل،() يجوز في حالات مختلفة اتخاذ قرار بفرض قيود على المشاركة في إجراءات الاشتراء.

The Working Group noted that the article had been revised further to consultations with experts, so that it allowed the procuring entity to limit participation in procurement proceedings on the basis of nationality on socio-economic grounds, and for other reasons, such as set-aside programmes for minorities, small and medium enterprises or indigenous groups.
40- لاحظ الفريق العامل أن المادة نُقحت عقب التشاور مع الخبراء بحيث يُسمح للجهة المشترية بأن تحدّ من المشاركة في إجراءات الاشتراء على أساس الجنسية لأسباب اجتماعية-اقتصادية أو لأسباب أخرى، مثل برامج التخصيص لصالح الأقليات أو المنشآت الصغيرة والمتوسطة أو الأهالي الأصليين.

(1) Suppliers or contractors are permitted to participate in procurement proceedings without regard to nationality, except in cases in which the procuring entity decides, on grounds specified in the procurement regulations or according to other provisions of law, to limit participation in procurement proceedings on the basis of nationality.
)١( يسمح للموردين أو المقاولين بالاشتراك في إجراءات الاشتراء بصرف النظر عن جنسياتهم، إلا في الحالات التي تقرر فيها الجهة المشترية، استنادا إلى أسباب تنص عليها لوائح الاشتراء أو وفقا ﻷحكام قانونية أخرى، حصر المشاركة في إجراءات الاشتراء على أساس الجنسية.

The exceptions from review found in paragraph (2) of the 1994 Model Law were deleted, the most notable of which were the selection of a procurement method or a selection procedure and the limitation of participation in procurement proceedings on the basis of nationality.
18- وحُذفت الاستثناءات من إعادة النظر المذكورة في الفقرة (2) من القانون النموذجي لعام 1994، ومن أبرزها اختيار طريقة الاشتراء أو إجراء الاختيار والحدِّ من المشاركة في إجراءات الاشتراء على أساس الجنسية.

4. Paragraph (2) is intended to cover situations where restriction of participation in procurement proceedings is undertaken wholly or partly for other reasons, such as to implement set-aside programmes for SMEs or entities from disadvantaged areas).
4- ويُقصد بالفقرة (2) أن تشمل الحالات التي تُقيَّد فيها المشاركة في إجراءات الاشتراء كلّياً أو جزئياً لأسباب أخرى مثل تنفيذ برامج التخصيص لصالح المنشآت الصغيرة والمتوسطة أو لصالح الكيانات الآتية من مناطق مغبونة.

These cases include: limitation of participation in procurement proceedings (article 8); authority and procedures for application of a margin of preference in favour of national suppliers or contractors (article 11); and use of the request-for-quotations method of procurement, since that method may be used only for procurement whose value is below threshold levels set out in the procurement regulations (article 28 (2)).
وتشتمل هذه الحالات على ما يلي: الحدّ من المشاركة في إجراءات الاشتراء (المادة 8)؛ وصلاحية تطبيق هامش التفضيل لصالح المورِّدين أو المقاولين الوطنيين وإجراءات هذا التطبيق (المادة 11)؛ واستخدام طلب عروض الأسعار كطريقة اشتراء نظراً لأنَّه لا يجوز استخدام هذه الطريقة إلاّ في الاشتراء الذي تقلّ قيمته عن المستويات العتبية المبيّنة في لوائح الاشتراء (المادة 28 (2)).
