(3) The procuring entity, when first soliciting the participation of suppliers or contractors in the procurement proceedings, shall specify:

2. Paragraph (1) refers to the minimum information that must be included when the procuring entity first solicits participation of suppliers or contractors in such procurement proceedings.

Such means are to be specified by the procuring entity when first soliciting the participation of suppliers or contractors in the procurement proceedings.
وتحدد الجهة المشترية هذه الوسائل عندما تلتمس للمرة الأولى مشاركة المورّدين أو المقاولين في إجراءات الاشتراء.

When first soliciting the participation of suppliers or contractors in the procurement involving open framework agreements, the procuring entity shall specify in addition to the information set out in the preceding article:

Any such restriction of participation of suppliers or contractors in procurement proceedings risks violating free-trade commitments by States under relevant international instruments, such as the World Trade Organization's Agreement on Government Procurement.
وأيُّ تقييد من هذا القبيل لمشاركة المورِّدين أو المقاولين في إجراءات الاشتراء يمكن أن يُخِلّ بما على الدول من التزامات بشأن التجارة الحرّة بمقتضى الصكوك الدولية ذات الصلة، مثل اتفاق منظمة التجارة العالمية المتعلق بالاشتراء الحكومي.

(4) A procuring entity that decides to limit participation of suppliers or contractors in procurement proceedings pursuant to this article shall include in the record of the procurement proceedings a statement of the reasons and circumstances on which it relied.
(4) تدرج الجهة المشترية التي تقرر الحدّ من مشاركة المورِّدين أو المقاولين في إجراءات الاشتراء عملاً بهذه المادة في سجل إجراءات الاشتراء بياناً بالأسباب والظروف التي استندت إليها في ذلك.

(5) The procuring entity shall make available to any member of the public, upon request, its reasons for limiting participation of suppliers or contractors in the procurement proceedings pursuant to this article.
(5) تتيح الجهة المشترية لأي فرد من الجمهور، عند الطلب، الاطّلاع على أسباب حدّها من مشاركة المورِّدين أو المقاولين في إجراءات الاشتراء عملاً بهذه المادة.

They may also specify the time frame within which the procuring entity must provide its reasons for limiting the participation of suppliers or contractors in the procurement proceedings to a person upon his/her request, as required under paragraph (5) of the article.
وقد تحدد أيضا الإطار الزمني الذي يتعين ضمنه على الجهة المشترية أن تقدِّم لأي شخص، عند طلبه، أسباب حدّها من مشاركة المورِّدين أو المقاولين في إجراءات الاشتراء، كما هو مطلوب بموجب الفقرة (5) من هذه المادة.

When such reasons exist, 2011 provisions require the procuring entity, when first soliciting the participation of suppliers or contractors in the procurement proceedings, to declare that participation is limited and provide a statement of the reasons and circumstances on which it relied to reach the decision to limit the participation (see 2011 paragraphs (3) and (4)).
وعندما توجد تلك الأسباب، فإنَّ أحكام عام 2011 تقتضي من الجهة المشترية أن تعلن، عند التماسها لأول مرة مشاركة المورِّدين أو المقاولين في إجراءات الاشتراء، أنَّ المشاركة محدودة وأن تصدر بياناً بالأسباب والظروف التي استندت إليها في الوصول إلى قرار الحدّ من المشاركة (انظر الفقرتين (3) و(4) لعام 2011).

To ensure predictability and proper review, control and audit, paragraph (3) of the article requires the procuring entity to specify, when first soliciting the participation of suppliers or contractors in the procurement proceedings, all requirements of form and the means of communications for a given procurement.
6- ولضمان إمكانية التنبّؤ وسلامة الاستعراض والمراقبة والتدقيق، تقضي الفقرة (3) من المادة بأن تحدّد الجهة المشترية، عندما تلتمس لأول مرة مشاركة المورِّدين أو المقاولين في إجراءات الاشتراء، جميع الاشتراطات المتعلقة بشكل ووسائل الاتصال في عملية اشتراء معيّنة.

(3) The procuring entity, when first soliciting the participation of suppliers or contractors in the procurement proceedings, shall declare whether participation of suppliers or contractors in the procurement proceedings is limited pursuant to this article and on which ground.
(3) تُعلن الجهة المشترية، عند التماسها لأول مرة مشاركة المورِّدين أو المقاولين في إجراءات الاشتراء، ما إذا كانت مشاركة المورِّدين أو المقاولين في إجراءات الاشتراء محدودة عملاً بهذه المادة، وأسباب ذلك الحد.

(2) Except when authorized or required to do so by the procurement regulations or other provisions of law of this State, the procuring entity shall establish no other requirement aimed at limiting participation of suppliers or contractors in procurement proceedings that discriminates against or among suppliers or contractors or against categories thereof.
(2) لا تَفرض الجهةُ المشترية، إذ تهدف إلى الحدّ من مشاركة المورِّدين أو المقاولين في إجراءات الاشتراء، أيَّ اشتراط أخر يمثّل تمييزاً تجاه المورِّدين أو المقاولين أو فيما بينهم، أو تجاه فئات منهم، إلاّ عندما تكون مخوّلة أو ملزمة بفعل ذلك بموجب لوائح الاشتراء التنظيمية أو بموجب أحكام أخرى من قانون هذه الدولة.

The Working Group requested the Secretariat to consider redrafting the broad reference to an " obstacle " to the participation of suppliers or contractors in the procurement proceedings in paragraph (2).

تُحدّدُ الجهةُ المشترية، عندما تلتمس لأول مرة مشاركة مورّدين أو مقاولين في اشتراء ينطوي على اتفاق إطاري، جميعَ المعلومات اللازمة بمقتضى هذا القانون عن طريقة الاشتراء المختارة، إلا متى كان في هذه المادة خروج على تلك الأحكام، وتُدرج علاوة على ذلك المعلومات التالية:

Any such restriction of participation of suppliers or contractors in procurement proceedings restricts trade and may violate commitments by States under relevant international instruments, such as [WTO GPA].
وأيُّ تقييد من هذا النوع لمشاركة المورِّدين أو المقاولين في إجراءات الاشتراء يقيِّد التعامل التجاري وقد يخلّ بالتزامات الدول بمقتضى الصكوك الدولية ذات الصلة مثل [الاتفاق المتعلق بالاشتراء الحكومي في إطار منظمة التجارة العالمية].
