٢- لا يؤثر تطبيق هذه اﻷحكام على المركز القانوني ﻷي طرف في نزاع مسلح.

وإذ تذكّر بالتزام كل طرف في أي نزاع مسلح بالتقيد بأحكام القانون اﻹنساني الدولي،

States not party to an armed conflict are also required under the common article 1 to neither encourage a party to violate international humanitarian law nor to take action that would assist in such violation.
وبموجب المادة المشتركة 1 يجب أيضا على الدول التي ليست طرفا في نزاع مسلح ألا تشجع أحد الأطراف على انتهاك القانون الإنساني الدولي أو تتخذ إجراءات من شأنها أن تساعد على هذا الانتهاك.

Finally, it is also useful to briefly recall that States not party to an armed conflict have responsibilities and a crucial role to play for the protection of civilians and those hors de combat and for the protection of their rights.
309- وختاماً من المفيد أيضا أن نشير بإيجاز إلى أن الدول غير الأطراف في نزاع مسلح تقع عليها مسؤوليات يكون لها دور حاسم تضطلع به في مجال حماية المدنيين والعاجزين عن القتال وحماية حقوقهم.
