(f) If a judge served for less than a full term of four years, the amount of the pension shall be that proportion of the annual pension which the number of months of his or her actual service bears to forty-eight;
(و) إذا عمل قاض أقل من مدة الأربع سنوات كاملة، يحصل على معاش تقاعدي يحدد على أساس المعاش التقاعدي السنوي بحسب نسبة عدد شهور خدمته الفعلية إلى ثمانية وأربعين شهرا؛

In the event of failing to do so the Institute must pay 100% of the pension which would probably be due to the applicant.

Should he or she so elect, the amount of such pension shall be that amount which has the same value as the retirement pension which would have been paid to him or her at the age of sixty.

' ٢ ' فإن لم يكن العضو السابق قد بدأ عند وفاته في تقاضي معاش تقاعدي، يكون هذا المقدار معادلا عشرة في المائة من المعاش الذي كان يستحقه العضو السابق بموجب أحكام من المادة اﻷولى، فيما لو كان قد بدأ في تقاضي هذا المعاش عند وفاته؛

The mother of nonmatrimonial children of the insured person will receive a benefit equivalent to 60% of the pension which she would have received if she had been a spouse.
وتحصل الأم لأطفالٍ ولدتهم خارج إطار الزوجية ومن أبٍ مؤمن عليه على استحقاقٍ يعادل نسبة 60 في المائة من المعاش الذي كانت ستتقاضاه لو كانت زوجته.

(ii) If the former judge had not begun, at the date of his or her death, to receive his or her retirement pension, 10 per cent of the pension which would have been payable to him or her under article 1, paragraph 3, had he or she commenced to receive such pension at the date of his or her death;
`٢` إذا، إن لم يكن القاضي السابق، عند وفاته، قد بدأ في تقاضي معاشه التقاعدي، عشرة في المائة من المعاش الذي كان سيستحقه بموجب أحكام الفقرة ٣ من المادة ١ لو كان قد بدأ في تقاضي هذا المعاش عند وفاته؛ أو

(iii) In the case of the death of a judge in office, 10 per cent of the pension which he or she would have received had he or she qualified for a disability pension at the date of his or her death;
' ٣ ' إذا توفى القاضي أثنـاء الخدمـة، عشرة في المائـة مـن المعاش الذي كان سيتقاضاه لو كان قد استحق معاش عجـز عند وفاته؛ بشرط ألا يتجاوز معاش الولد.

In respect of ICTY, the basis for the computation is " that proportion of the annual pension which the number of months of his or her actual service bears to forty-eight " .
وفيما يتعلق بمحكمة يوغوسلافيا السابقة، فإن أساس الحساب يحدد " على أساس المعاش التقاعدي السنوي بحسب نسبة عدد شهور خدمته الفعلية إلى ثمانية وأربعين شهرا " .

Should he/she so elect, the amount of such pension shall be that amount which has the same actuarial value as the retirement pension which would have been paid to him/her at the age of 60.
ويحدد مقدار معاشه في هذه الحالة بنفس القيمة الحسابية الاكتوارية للمعاش التقاعدي الذي كان سيدفع له عند بلوغه سن الستين.
