1. The purpose of the article is to enable the procuring entity to reject a submission whose abnormally low price gives rise to concerns as to the ability of the supplier or contractor presenting such submission to perform the procurement contract.
1- الغرض من هذه المادة هو تمكين الجهة المشترية من رفض العرض الذي يثير سعره المنخفض انخفاضا غير عادي شواغل بشأن قدرة المورِّد أو المقاول الذي قدّمه على تنفيذ عقد الاشتراء.

Submission which price in combination with other constituent elements of the submission is so abnormally low in relation to the subject matter of the procurement that it raises concerns with the procuring entity as to the ability of the supplier or contractor that presented it to perform the procurement contract.
هو العرض المقدَّم الذي يكون سعره، بالاقتران مع سائر العناصر المكوِّنة، منخفضاً بالقياس إلى الشيء موضوع الاشتراء انخفاضاً غير عادي بحيث يثير لدى الجهة المشترية شواغل بشأن مدى قدرة المورِّد أو المقاول الذي قدَّم ذلك العرض على تنفيذ عقد الاشتراء.

4. For these reasons, the article protects suppliers and contractors against the possibility of arbitrary decisions and abusive practices by procuring entities by allowing the rejection of an abnormally low submission only when the procuring entity has taken steps to substantiate its concerns as to the ability of the supplier or contractor to perform the procurement contract.
4- ولهذه الأسباب، تحمي هذه المادة المورِّدين والمقاولين من احتمال اتخاذ الجهة المشترية قرارات اعتباطية أو اتّباعها ممارسات تعسّفية، إذ لا تسمح برفض عرض منخفض انخفاضا غير عادي إلاّ في حال اتخاذ الجهة المشترية خطوات لإثبات دواعي قلقها إزاء قدرة المورِّد أو المقاول على تنفيذ عقد الاشتراء.

To deter the submission of abnormally low submissions and promote responsible behaviour on the part of suppliers and contractors, it may be desirable for procuring entities to specify in the solicitation documents or other equivalent documents that submissions may be rejected if they are abnormally low and raise concerns with the procuring entity as to the ability of the supplier or contractor to perform the procurement contract.
ومن أجل الردع عن تقديم عروض منخفضة انخفاضا غير عادي، وتشجيع المورِّدين والمقاولين على اتباع سلوك مسؤول، قد يُستحسن أن تنصّ الجهات المشترية في وثائق الالتماس أو غيرها من الوثائق المعادلة على أنَّ العروض المقدّمة قد تُرفض إذا كانت منخفضة انخفاضا غير عادي وإذا كانت تثير لدى الجهة المشترية شواغل بشأن قدرة المورِّد أو المقاول على تنفيذ عقد الاشتراء.

The Working Group agreed with the suggestion that reference to the applicable ethical and other standards should be removed from paragraph (2) (i) and should be set out as a separate requirement not linked to the ability to perform the procurement contract.
122- وأبدى الفريق العامل موافقته على الاقتراح الداعي إلى الإشارة إلى ما هو معمول به من معايير أخلاقية ومعايير أخرى ينبغي أن تُزال من الفقرة (2) `1` وأن ترد كشرط منفصل لا يرتبط بالقدرة على تنفيذ عقد الاشتراء.

At that session, the Working Group agreed to amend article 12 bis (a) and (b) as to provide more clarity to the term ALT, by referring to the constituent elements of tender in the context of the price that might raise concern with the procuring entity on the ability of the supplier or contractor to perform the procurement contract (A/CN.9/640, paras. 44-55).
