فمن الطبيعي إذن أن تُنسب الأعمال المُشتكى منها، التي حصلت خلال أداء وظائف رسمية بحضور موظفي الدولة الطرف وداخل إقليمها، إلى الدولة الطرف نفسها بالإضافة إلى الدولة التي يعمل لحسابها هؤلاء الموظفون.
