Some doubt was expressed regarding this view, however, and it was agreed that the concern regarding the inclusion of the maritime performing party would be noted.

However, broad support was expressed for the rationale behind the proposal with regard to the situation in which the carrier or a performing party had actually inspected the goods.

Secondly, the definition was aimed at regulating the vicarious liability of the performing party for its employees or others working in its service.

(i) Neither the carrier nor a performing party weighed the container, and the shipper and the carrier had not agreed prior to the shipment that the container would be weighed and the weight would be included in the contract particulars; or
`1` لم يزن الناقل ولا الطرف المنفّذ الحاوية، ولم يكن الشاحن والناقل قد اتفقا قبل الشحن على أن توزن الحاوية وأن يدرج الوزن في تفاصيل العقد؛ أو

It includes agents or subcontractors of a performing party to the extent that they likewise perform or undertake to perform any of the carrier's obligations under a contract of carriage.
وهو يشمل وكلاء الطرف المنفِّذ أو المتعاقدين من الباطن معه طالما كانوا يؤدّون بالمثل، أو يتعهّدون بالمثل بأن يؤدّوا، أيّا من التزامات الناقل بمقتضى عقد النقل.

First, any person who had a right of suit under the contract of carriage against the carrier would also have a right of suit against any performing carrier or performing party.
أولا، أي شخص يكون لــه الحق في رفع دعوى بمقتضى عقد النقل ضد الناقل سيكون لـه الحق أيضا في رفع دعوى ضد أي ناقل منفذ أو طرف منفذ.

The period of responsibility of the carrier for the goods under this Convention begins when the carrier or a performing party receives the goods for carriage and ends when the goods are delivered.

ولا يكون الناقل الداخلي طرفا منفذا بحريا إلا إذا كان يؤدي أو يتعهد بأن يؤدي خدماته حصرا داخل منطقة الميناء.

A view was expressed that the existing definitions of performing party and maritime performing party were broad enough to include these persons.
وأُعرب عن رأي مؤداه أن التعريفين الحاليين للطرف المنفّذ والطرف المنفّذ البحري واسعان بقدر يكفي لشمول هؤلاء الأشخاص.

An inland carrier is a maritime performing party only if it performs or undertakes to perform its services exclusively within a port area.
ولا يعتبر الناقل الداخلي طرفا منفِّذا بحريا إلاّ إذا كان يؤدّي، أو يتعهّد بأن يؤدّي خدماته حصرا داخل منطقة ميناء.

Nothing in this Convention affects a right of the carrier or a performing party that may exist pursuant to the contract of carriage or the applicable law to retain the goods to secure the payment of sums due.
ليس في هذه الاتفاقية ما يمس بما قد يكون للناقل أو للطرف المنفذ من حق في الاحتفاظ بالبضاعة، بمقتضى عقد النقل أو القانون المنطبق، ضمانا لسداد المبالغ المستحقة له.

Some concern was expressed with respect to this narrowed definition of performing party, particularly with the Himalaya protection which, it was thought, should be available to all performing parties.
