2- يُعفى الناقل من كامل مسؤوليته التي تقضي بها الفقرة 1 من هذه المادة أو من جزء منها إذا أثبت أن سبب الهلاك أو التلف أو التأخر أو أحد أسبابه لا يعزى إلى خطأ ارتكبه هو أو أي شخص مشار إليه في المادة 19.

(a) If the claimant proves that the fault of the carrier or of a person referred to in article 19 caused or contributed to the event or circumstance on which the carrier relies; or
(أ) إذا أثبت المطالب أن الخطأ الذي ارتكبه الناقل أو شخص مشار إليه في المادة 19 قد تسبَّب أو أسهم في الحدث أو الظرف الذي يستند إليه الناقل؛ أو

Except in respect of loss or damage caused by a breach by the shipper of its obligations pursuant to articles 32, paragraph 2, and 33, the shipper is relieved of all or part of its liability if the cause or one of the causes of the loss or damage is not attributable to its fault or to the fault of any person referred to in article 35.
2- باستثناء ما يتعلق بالخسارة أو الضرر الناجم عن إخلال الشاحن بواجباته بمقتضى الفقرة 2 من المادة ٣2 والمادة ٣٣، يعفى الشاحن من كل مسؤوليته أو جزء منها إذا كان سبب الخسارة أو الضرر أو أحد أسبابه لا يُعزى إلى خطأ ارتكبه هو أو أي شخص مشار إليه في المادة ٣5.

" (a) The time of receipt of the goods is subsequent to the time when the carrier or any person referred to in article 19 has actually received the goods or
(أ) أن يكون وقت تسلُّم البضاعة لاحقا للوقت الذي يكون فيه الناقل أو أيُّ شخص مشار إليه في المادة 19 قد تسلّم البضاعة بالفعل، أو

" (b) The time of delivery of the goods is prior to the time when the carrier or any person referred to in article 19 has actually delivered the goods. "
(ب) أن يكون وقت تسليم البضاعة سابقا للوقت الذي يكون فيه الناقل أو أيُّ شخص مشار إليه في المادة 19 قد سلّم البضاعة بالفعل. "

2. The carrier is relieved of all or part of its liability pursuant to paragraph 1 of this article if it proves that the cause or one of the causes of the loss, damage, or delay is not attributable to its fault or to the fault of any person referred to in article 19.
2- يُعفى الناقل من كامل مسؤوليته التي تقضي بها الفقرة 1 من هذه المادة أو من جزء منها إذا أثبت أن سبب الهلاك أو التلف أو التأخر أو أحد أسبابه لا يُعزى إلى خطأ ارتكبه هو أو أي شخص مشار إليه في المادة 19.

" 2. Except in respect of loss or damage caused by a breach by the shipper of its obligations under articles 31 [, paragraph 2,] and 32, the shipper is relieved of all or part of its liability if the cause or one of the causes of the loss or damage is not attributable to its fault or to the fault of any person referred to in article 34. (1) Diplomatic protection consists of resort to diplomatic action or other means of peaceful settlement by a State adopting in its own right the cause of its national or a person referred to in article 8 in respect of an injury to that national or person arising from an internationally wrongful act of another State.
(1) تعني الحماية الدبلوماسية لجوء الدولة إلى إجراء دبلوماسي أو غير ذلك من وسائل التسوية السلمية عندما تتبنى، بحكم حقها الذاتي، قضية أحد رعاياها أو شخص مشار إليه في المادة 8 فيما يتصل بضرر لحق بهذا المواطن أو الشخص من جراء فعل غير مشروع دوليا قامت به دولة أخرى.

If the carrier, after reasonable effort, is unable to identify and find the controlling party, or the controlling party is unable to provide adequate information, instructions, or documents to the carrier, the obligation to do so shall be on the shipper or the person referred to in article 7.7.
وإذا تعذر على الناقل، بعد بذل جهد معقول، التعرف على الطرف المسيطر والعثور عليه، أو تعذر على الطرف المسيطر تزويد الناقل بمعلومات أو تعليمات أو مستندات وافية، يقع الالتزام بفعل ذلك على عاتق الشاحن أو الشخص المشار إليه في المادة 7-7.
