STATUS OF THE personnel of the United Nations force AND ASSOCIATED CIVILIAN PERSONNEL

Acknowledging the vital importance of the involvement of the personnel of the United Nations force and associated civilian personnel in preventive diplomacy, peacemaking, peace-keeping, peace-building and humanitarian operations,
وإذ تعترف باﻷهمية الحيوية ﻹشراك أفراد قوات اﻷمم المتحدة والموظفين المدنيين المرتبطين بها في الدبلوماسية الوقائية وصنع السلم وحفظ السلم وبناء السلم والعمليات اﻹنسانية،

3. personnel of the United Nations force and associated civilian personnel in fulfilling their duties shall be accorded the following privileges and immunities:
٣ - يمنح أفراد قوات اﻷمم المتحدة والموظفون المدنيون المرتبطون بها، لدى أدائهم لواجباتهم، الامتيازات والحصانات التالية:

The Government of a State Party in whose territory the United Nations peace-keeping operation is conducted or the administration exercising actual authority over the territory in question and/or the area of the operation shall respect the exclusive international character of the personnel of the United Nations force and associated civilian personnel.
تحترم حكومة الدولة الطرف التي تجري في أراضيها عملية اﻷمم المتحدة لحفظ السلم، أو اﻹدارة التي تمارس السلطة الفعلية على اﻹقليم المعني و/أو منطقة العملية، الطابع الدولي الخالص ﻷفراد قوات اﻷمم المتحدة والموظفين المدنيين المرتبطين بها.

It also welcomed the draft international convention on the status and safety of the personnel of the United Nations force and associated civilian personnel, proposed by Ukraine.
وقال إن وفده يرحب كذلك بمشروع الاتفاقية الدولية بشأن مركز وسلامة أفراد قوات اﻷمم المتحدة والموظفين المدنيين المرتبطين بها، الذي اقترحته أوكرانيا.

2. In cases not covered by the present Convention or by other international agreements, the personnel of the United Nations force and associated civilian personnel remain under the protection of universally recognized principles of international law, in particular norms of international humanitarian law.
٢ - في الحالات غير المشمولة بهذه الاتفاقية أو بأي اتفاقات دولية أخرى، يظل أفراد قوات اﻷمم المتحدة والموظفون المدنيون المرتبطون بها يتمتعون بالحماية التي تكفلها مبادئ القانون الدولي المعترف بها عالميا، ولا سيما قواعد القانون اﻹنساني الدولي.

The United Nations shall take appropriate measures to make the personnel of the United Nations force and associated civilian personnel as well as buildings and equipment identifiable when they are exclusively destined for carrying out a mandate approved by the Security Council, namely:
تتخذ اﻷمم المتحدة التدابير المناسبة ﻹظهار هوية أفراد قوات اﻷمم المتحدة والموظفين المدنيين المرتبطين بها، فضلا عن المباني والمعدات، الذين يكون الهدف منهم على وجه الحصر الاضطلاع بولاية وافق عليها مجلس اﻷمن، وهذه الترتيبات هي ما يلي:

1. personnel of the United Nations force and associated civilian personnel shall have the right of unimpeded entry and exit to and from a State in whose territory the United Nations peace-keeping operation is conducted.
١ - يتمتع أفراد قوات اﻷمم المتحدة والموظفون المدنيون المرتبطون بها بالحق في دخول الدولة التي تجري في أراضيها عملية اﻷمم المتحدة لحفظ السلم وكذلك في الخروج منها دون عائق.

2. In the case of a committed crime by a member of the personnel of the United Nations force and associated civilian personnel the jurisdiction of the State of permanent citizenship shall apply.
٢ - في حالـة ارتكاب أحد أفراد قوات اﻷمم المتحدة أو أحد الموظفين المدنيين المرتبطين بها جريمة ما، تنطبق الولاية القضائية للدولة التي يتمتع بالمواطنة الدائمة فيها.

Breaches of the Convention Attacks and other acts of violence, whether actual or threatened, against the personnel of the United Nations force and associated civilian personnel, including kidnapping, obstruction or detention of persons, shall be considered a criminal offence and shall entail international responsibility in accordance with this Convention and relevant norms of international law.
تعتبر عمليات الاعتداء وغيرها من أعمال العنف ضد أفراد قوات اﻷمم المتحدة والموظفين المدنيين المرتبطين بها، سواء وقعت بالفعل أو كان هناك تهديد بوقوعها، بما في ذلك اختطاف اﻷفراد أو إعاقة حركتهم أو احتجازهم، مخالفات جنائية، يترتب عليها مسؤولية دولية وفقا لهذه الاتفاقية ولمعايير القانون الدولي ذات الصلة.

(1) The United Nations flag shall be hoisted in the headquarters, camps or other premises and areas of stationing of the personnel of the United Nations force and associated civilian personnel in the country where the United Nations peace-keeping operation is conducted;
)١( يُرفع علم اﻷمم المتحدة على المقر والمعسكرات أو اﻷماكن اﻷخرى والمناطق التي يرابط فيها أفراد قوات اﻷمم المتحدة والموظفون المدنيون المرتبطون بها في البلد الذي تجري فيه عملية اﻷمم المتحدة لحفظ السلم؛

(6) In an area where fighting is taking place or is likely to take place the personnel of the United Nations force and associated civilian personnel should be recognized by the distinctive emblem and an identity card certifying their international status.
)٦( في المنطقة التي تشهد قتالا أو يرجح أن تشهد قتالا، يميز أفراد قوات اﻷمم المتحدة والموظفون المدنيون المرتبطون بها بالشارة المميزة، وببطاقة هوية تثبت مركزهم الدولي.

For the purposes of such entry or exit personnel of the United Nations force and associated civilian personnel require only an identity card issued by the special representative/force commander. An exception shall be made in the case of initial entry, when an identity card issued by the competent authorities of a State Party shall be accepted.
ولا يحتاج أفراد قوات اﻷمم المتحدة والموظفون المدنيون المرتبطون بها لدى دخولهم أو خروجهم إلا لبطاقات هوية صادرة عن الممثل الخاص/قائد القوة، وذلك باستثناء حالات الدخول ﻷول مرة حيث تقبل بطاقة هوية صادرة من السلطات المختصة في دولة طرف.

1. Without prejudice to their privileges and immunities and fulfilling of their duties, the personnel of the United Nations force and associated civilian personnel shall respect the laws and regulations of a State Party in whose territory the United Nations peace-keeping operation is conducted.
١ - يحترم أفراد قوات اﻷمم المتحدة والموظفون المدنيون المرتبطون بها، لدى الاضطلاع بمهامهم ودون المساس بامتيازاتهم وحصاناتهم، قوانين وأنظمة الدولة الطرف التي تجري عملية حفظ السلم التابعة لﻷمم المتحدة في أراضيها.

2. The Government of a State Party in whose territory the United Nations peace-keeping operation is conducted shall guarantee criminal prosecution of persons initiating hostile acts against the personnel of the United Nations force and associated civilian personnel.
٢ - تضمن حكومة الدولة الطرف التي تجري في أراضيها عملية اﻷمم المتحدة لحفظ السلم تابعة لﻷمم المتحدة المقاضاة الجنائية لﻷشخاص الذين يرتكبون أعمالا عدائية ضد أفراد قوات اﻷمم المتحدة أو الموظفين المدنيين المرتبطين بها.

(3) personnel of the United Nations force and associated civilian personnel shall at all times carry the distinctive emblem on their uniform, which also shall be reported to the Government of the State in whose territory the United Nations peace-keeping operation is conducted.
)٣( يحمل أفراد قوات اﻷمم المتحدة والموظفون المدنيون المرتبطون بها، في جميع اﻷوقات، الشارة المميزة على الزي الذي يرتدونه، وتخطر بهذا أيضا حكومة الدولة التي تجري في أراضيها عملية اﻷمم المتحدة لحفظ السلم.

(5) Each State Party, as well as a party to a conflict, shall endeavour to adopt and implement methods and procedures that will make it possible to recognize the personnel of the United Nations force and associated civilian personnel and transports that use the distinctive emblem;
)٥( تعمل كل دولة من الدول اﻷطراف، فضلا عن أي طرف في النزاع، على اعتماد وتنفيذ وسائل وإجراءات من شأنها أن تتيح تمييز أفراد قوات اﻷمم المتحدة والموظفين المدنيين المرتبطين بها ووسائل النقل التي تستخدم الشارة المميزة؛

In the case of death, wound or other injury of a member of the personnel of the United Nations force or associated civilian personnel or damage of equipment and technical means of the United Nations peace-keeping force, the United Nations shall pay compensation to the beneficiary upon the request of a State whose national is killed or injured or whose property and equipment are damaged.
في حالة موت أو جرح فرد من أفراد قوات اﻷمم المتحدة أو الموظفين المدنيين المرتبطين بها أو حدوث أي إصابة أخرى له أو إلحاق ضرر بالمعدات والوسائل التقنية لقوات اﻷمم المتحدة لحفظ السلم، تقوم اﻷمم المتحدة بدفع تعويض للمستحقين، بناء على طلب الدولة التي قتل مواطنها أو جُرح أو التي أصيبت ممتلكاتها أو معداتها بأضرار.

1. A State Party in whose territory the United Nations peace-keeping operation is conducted undertakes to provide comprehensive support to the personnel of the United Nations force and associated civilian personnel in fulfilling their functions, as well as to take all necessary measures to ensure respect and guarantee safety and security of those personnel.
١ - تتعهد الدولة الطرف التي تجري في أراضيها عملية اﻷمم المتحدة لحفظ السلم بتقديم الدعم الشامل ﻷفراد قوات اﻷمم المتحدة والموظفين المدنيين المرتبطين بها عند اضطلاعهم بوظائفهم، فضلا عن اتخاذ جميع التدابير اللازمة لكفالة احترامهم وضمان سلامتهم وأمنهم.

(2) Ground, water and air transportation vehicles of the personnel of the United Nations force and associated civilian personnel shall be marked by the distinctive United Nations emblem reported to the Government of the State in whose territory the United Nations peace-keeping operation is conducted;
)٢( تميز مركبات النقل البري والبحري والجوي التابعة ﻷفراد قوات اﻷمم المتحدة والموظفين المدنيين المرتبطين بها بواسطة شارة اﻷمم المتحدة المميزة على أن تخطر بها حكومة الدولة التي يضطلع فيها بعملية اﻷمم المتحدة لحفظ السلم؛
