23- ومن الواضح أن العهد، خلافاً للإعلان العالمي لحقوق الإنسان الذي ينص على " الإنصاف الفعلي " ، يقضي بتوفير " سبيل فعال للتظلم " ، حتى لو صدر الانتهاك عن أشخاص يتصرفون بصفتهم الرسمية.

1. Any person whose rights under the Constitution, an international treaty, the law or any other regulation are violated should have the right to seek a remedy from the competent domestic authorities, even where the violation has been committed by persons acting in an official capacity.
1- يُكفل لكل شخص تُنتهك حقوقه التي يضمنها الدستور، أو اتفاقية دولية، أو القانون، أو أي قواعد تنظيمية أخرى، سبيل للانتصاف أمام السلطات الوطنية المختصة، حتى لو صدر الانتهاك عن أشخاص يتصرفون بصفتهم الرسمية.

22. 37. He noted the particular importance of article 2, paragraph 3 (a), of the Covenant, whereby States parties to the Covenant undertook to ensure that any person whose rights or freedoms as recognized therein were violated would have an effective remedy, notwithstanding that the violation had been committed by persons acting in an official capacity.
