وإذ تعترف بأن المادة ٣٨ من الاتفاقية تجيز تجنيد اﻷشخاص في القوات المسلحة واشتراكهم اشتراكا مباشرا في الحرب بعد بلوغهم سن الخامسة عشرة،

Convinced that an Optional Protocol to the Convention, raising the age of possible recruitment of persons into armed forces and their participation in hostilities, will contribute effectively to the implementation of the principle that the best interests of the child are to be a primary consideration in all actions concerning children,
واقتناعا منها بأن بروتوكولا اختياريا للاتفاقية، يرفع السن التي يجوز فيها تجنيد اﻷشخاص في القوات المسلحة واشتراكهم مباشرة في اﻷعمال الحربية إلى ثماني عشرة سنة، سيساهم فعليا في تنفيذ المبدأ القائل إن مصالح الطفل الفضلى يجب أن تكون الاعتبار اﻷول في جميع اﻹجراءات التي تتعلق باﻷطفال،

واقتناعا منها بأن بروتوكولا اختياريا للاتفاقية، يرفع السن التي يجوز فيها تجنيد اﻷشخاص في القوات المسلحة واشتراكهم في اﻷعمال الحربية، سيساهم مساهمة فعالة في تنفيذ المبدأ القائل إن مصالح الطفل الفضلى يجب أن تكون الاعتبار اﻷول في جميع اﻹجراءات التي تتعلق باﻷطفال،

15. It was generally felt that the practice of the use of children as soldiers should be eradicated and that, as one of the means to achieve this purpose, the minimum age for recruitment of persons into armed forces should be raised.
٥١- وساد شعور عام بأن ممارسة استخدام اﻷطفال جنودا ينبغي استئصالها وأن من وسائل بلوغ هذه الغاية أن يرفع الحد اﻷدنى لسن تجنيد اﻷشخاص في القوات المسلحة.

وإقتناعا منها بأن بروتوكولا اختياريا للاتفاقية، يرفع السن التي يجوز فيها تجنيد اﻷشخاص في القوات المسلحة واشتراكهم اشتراكاً مباشرا في اﻷعمال الحربية إلى ثماني عشرة سنة، سيساهم فعليا في تنفيذ مبدأ أن يكون الاعتبار اﻷول في جميع اﻹجراءات التي تتعلق باﻷطفال هو توخي مصالح الطفل الفضلى،

7. This clause revises article 38 (3) of the Convention on the Rights of the Child which, as recognized in the preamble to the draft protocol, allows the recruitment of persons into armed forces and their direct participation in hostilities after the attainment of the age of 15 years.
٧- وهذا النص يعدل المادة ٣٨ )٣( من اتفاقية حقوق الطفل التي تسمح، كما هو معترف به في ديباجة مشروع البروتوكول، بتجنيد اﻷشخاص في القوات المسلحة واشتراكهم مباشرة في العمليات الحربية بعد بلوغ سن ١٥ عاما.
