٦٣٢- تطلب شركة Hidrogradnja، باﻹضافة إلى ذلك، تعويضا مقداره ٨٣٩ ٥٣٢ ٥ دولاراً عن مبالغ موجودة في حساب السندات اﻹذنية في ٢ آب/أغسطس ٠٩٩١ ولكن لم يصدر بها سندات إذنية أبدا.

The Panel finds that the evidence establishes that the balance in the PN account has been correctly stated, that the amounts in the account were based on ICs which had been approved by the Employer, and that no PNs had been issued or paid in respect of this balance.

٧٣٢- ولم يجر تناول المطالبة بمبلغ ٥٤٦ ٣١٥ دولاراً عن الفائدة على حساب السندات اﻹذنية لﻷسباب المبينة في الفقرة ٣٣٢، أعلاه.

Moreover, several disputes involving significant sums had arisen with the Employer over claims for additional work.Unlike Enka, Hidrogradnja had not addressed the problem of financing costs, having made no arrangement to sell the PNs issued by the Employer.
٦٦٢- ولم تعالج شركة Hidrogradnja، خلافاً لما قامت به Enka، مشكلة تكاليف التمويل، إذ أنها لم تقم بأي ترتيب لبيع السندات اﻹذنية الصادرة عن رب العمل.

The Bank of Turkey was involved indirectly in financing the Project through an arrangement to purchase the PNs periodically issued to Enka by the Employer and guaranteed by the Rafidain Bank of Iraq.
٥١٤- شارك مصرف تركيا بصفة غير مباشرة في تمويل المشروع بعقده ترتيباً لشراء السندات اﻹذنية التي كان رب العمل يصدرها دورياً لحساب شركة Enka وكان يضمنها مصرف الرافدين العراقي.

٤٢٤- وذكر مصرف تركيا في إجاباته أيضا أن عنصر المطالبة المتعلق بالفوائد ينبغي تحديثه ﻹضافة الفوائد حتى حلــــول أجل استحقاق السندات اﻹذنية.

The Bank of Turkey indirectly financed the Project through an agreement under which it purchased PNs issued by the Employer in favor of Enka.
وقد أسهم مصرف تركيا بصفة غير مباشرة في تمويل المشروع بعقده اتفاقاً اشترى بمقتضاه سندات إذنية أصدرها رب العمل لحساب شركة Enka.

Thus, the Bank of Turkey’s claim is not compensable to the extent that it is based on PNs issued in respect of work performed prior to 2 May 1990.
