Article 14 addresses one of the most important and certainly most difficult aspects of the protection of minorities, as already indicated by the Permanent Court of International Justice in connection with a dispute on the acquisition of Polish nationality.

(10) Article 91 of the Treaty of Versailles established a right of option for German nationals habitually resident in territories recognized as forming part of Poland who acquired Polish nationality ipso facto and for Poles who were German nationals habitually resident in Germany or in a third country.Article 91 read as follows:

Article 91 further contained provisions analogous to those in article 85 concerning the right of option of German nationals habitually resident in territories recognized as forming part of Poland who acquired Polish nationality ipso facto.Ibid.

This principle was also asserted by the Permanent Court of International Justice in its opinion with regard to the Nationality Decrees Issued in Tunis and Morocco,P.C.I.J., 1923, Series B, No. 4, p. 24. and in its opinion on the question concerning the Acquisition of Polish nationality,Ibid., No. 7, p. 16. and it was reiterated by the International Court of Justice in the Nottebohm case.I.C.J. Reports, 1955, p. 4.

Article 91 of the Treaty of Versailles contains essentially similar provisions concerning the right of option for German nationals habitually resident in territories recognized as forming part of Poland who acquired Polish nationality ipso facto and for Poles who were German nationals habitually resident in Germany or in a third country.

In its introduction to the question, the Council states: " The Polish Government has decided to treat certain persons, who were formerly German nationals [ressortissants], as not having acquired Polish nationality and as continuing to possess German nationality, which exposes them in Poland to the treatment laid down for persons of non-Polish nationality, and in particular of German nationality " .
