185. IMO reported that its Assembly at its twenty-first session had adopted resolution A.896(21) on the " Provision and use of port waste reception facilities " (see A/54/429, para. 410).

The General Assembly in its resolution 61/222 noted with appreciation the efforts of IMO in developing and approving an action plan to address the inadequacy of port waste reception facilities, and urged States to cooperate in correcting the shortfall in such facilities in accordance with the action plan (see A/61/63/Add.1, para. 91).

As regards regional arrangements for port waste reception facilities, MEPC recalled the obligation of each Party to MARPOL 73/78 to provide reception facilities and the provisions of the Guidelines for Ensuring the Adequacy of Port Reception Facilities (resolution MEPC.83(44)).
وبصدد الترتيبات الإقليمية المتعلقة بمرافق استلام النفايات في الموانئ، أشارت اللجنة إلى التزام كل طرف في اتفاقية ماربول 73/78 بتوفير مرافق لاستلام النفايات وإلى أحكام المبادئ التوجيهية لكفالة كفاية مرافق استلام النفايات في الموانئ (القرار MEPC.83(44)).

In the draft guidelines for ensuring the adequacy of port waste reception facilities and the Management/Auditing Strategy to be finalized at MEPC 44, States parties are reminded of their obligations under MARPOL as well as UNCLOS: reference is made to articles 192, 194 and 211(2).
