وإذ تسلم بأن ممارسة اﻹخلاء القسري كثيراً ما تنطوي على إبعاد اﻷشخاص واﻷسر والمجموعات عن بيوتهم وأراضيهم ومجتمعاتهم قسراً ورغم إرادتهم، مما يسفر عن زيادة التشرد وعن وجود أوضاع إسكان ومعيشة غير لائقة،

Concerned that women and children suffer disproportionately from the practice of forced eviction and that women bear the brunt of traumatized and dislocated communities,
وإذ يقلقها أن النساء واﻷطفال يعانين بصورة غير متناسبة من ممارسة اﻹخلاء القسري وأن النساء يتحملن العبء اﻷكبر الذي يثقل كاهل الجماعات المعرﱠضة لصدمات والمبعدة عن أماكنها،

Recognizing that the often violent practice of forced eviction involves the coerced and involuntary removal of persons, families and groups from their homes, lands and communities, whether or not deemed legal under prevailing systems of law, resulting in greater homelessness and inadequate housing and living conditions,
وإذ تسلم بأن ممارسة اﻹخلاء القسري التي كثيراً ما تتسم بالعنف تنطوي على إبعاد اﻷشخاص واﻷسر والمجموعات عن منازلهم وأراضيهم ومجتمعاتهم قسراً ورغم إرادتهم، سواء أكان ذلك يعتبر أمراً قانونياً أم لا بموجب النظام القانوني المعمول به، مما يسفر عن زيادة التشرد وعن وجود أوضاع إسكان ومعيشة غير لائقة،

1. Reaffirms that the practice of forced eviction that is contrary to laws that are in conformity with international human rights standards constitutes a gross violation of a broad range of human rights, in particular the right to adequate housing;
1- تؤكد من جديد أن عمليات الإخلاء القسري المخالفة للقوانين التي تتفق ومعايير حقوق الإنسان الدولية تشكل انتهاكاً جسيماً لمجموعة كبيرة من حقوق الإنسان، وخاصة الحق في السكن اللائق؛

2. Strongly urges Governments to undertake immediately measures at all levels aimed at eliminating the practice of forced eviction by, inter alia, ensuring the right to security of tenure for all residents;
٢- تحث بقوة الحكومات على اتخاذ تدابير في الحال، على جميع المستويات، بهدف القضاء على ممارسة اﻹخلاء القسري عن طريق القيام، في جملة أمور، بضمان الحق في أمن الحيازة بالنسبة إلى جميع المقيمين؛

Women, children and youth, indigenous peoples, ethnic, racial, religious or other minorities, low-income social groups, populations living under occupation and those without the legal security of tenure tend to suffer disproportionately from the practice of forced eviction.
إن النساء واﻷطفال والشباب والسكان اﻷصليون واﻷقليات اﻹثنية والعرقية والدينية وغيرها من اﻷقليات والفئات الاجتماعية المنخفضة الدخل والسكان الذين يعيشون تحت الاحتلال والسكان الذين لا يتمتعون بحيازة مضمونة قانوناً يعانون عادة أكثر من غيرهم من ممارسة اﻹخلاء القسري.

120. At its forty-sixth session the Subcommission, in its resolution 1994/39, strongly urged Governments to undertake immediately all necessary measures towards eliminating the practice of forced eviction.
٠٢١- وحثت اللجنة الفرعية في قرارها ٤٩٩١/٩٣ المتخذ في دورتها السادسة واﻷربعين الحكومات بشدة على أن تتخذ كل التدابير الفورية اللازمة بهدف القضاء سريعا على ممارسة اﻹخلاء القسري.

106. In the same resolution, the Sub-Commission requested the Secretary-General to convene an expert seminar on the practice of forced eviction and the relationship of this practice to internationally recognized human rights, with a view to developing comprehensive human rights guidelines on development-based displacement.
٦٠١- وفي القرار نفسه، طلبت اللجنة الفرعية إلى اﻷمين العام أن يعقد حلقة دراسية للخبراء بشأن ممارسة اﻹخلاء القسري وعلاقة هذه الممارسة بحقوق اﻹنسان المعترف بها دولياً بغية وضع مبادئ توجيهية شاملة في مجال حقوق اﻹنسان بشأن مسألة الترحيل بدافع التنمية.

76. In the same resolution, the Sub-Commission requested the Secretary-General to convene an expert seminar on the practice of forced eviction and the relationship of this practice to internationally recognized human rights, with a view to developing comprehensive human rights guidelines on development-based displacement.
٦٧- وفي القرار نفسه، طلبت اللجنة الفرعية إلى اﻷمين العام أن يعقد حلقة دراسية للخبراء بشأن ممارسة اﻹخلاء القسري وعلاقة هذه الممارسة بحقوق اﻹنسان المعترف بها دولياً بغية وضع مبادئ توجيهية شاملة في مجال حقوق اﻹنسان بشأن مسألة الترحيل بدافع التنمية.

1. Reaffirms that the practice of forced eviction constitutes a gross violation of a broad range of human rights, in particular the right to adequate housing, the right to remain, the right to food, the right to freedom of movement, the right to privacy, the right to security of the home, the right to security of the person, the right to security of tenure, the right to equality of treatment and a variety of additional rights;
١- تؤكد من جديد أن ممارسة اﻹخلاء القسري تشكل انتهاكا جسيماً لمجموعة واسعة من حقوق اﻹنسان، ولا سيما الحق في السكن اللائق، وحق البقاء، والحق في الغذاء، والحق في حرية التنقل، والحق في حرمة الحياة الخاصة، والحق في أمن المنزل، والحق في أمن الشخص، والحق في أمن الحيازة، والحق في المساواة في المعاملة، باﻹضافة إلى مجموعة متنوعة من الحقوق اﻹضافية؛

21. By its resolution 1995/29 of 24 August 1995, the Sub-Commission took note of the report of the Secretary-General on guidelines on international events and forced evictions (E/CN.4/Sub.2/1995/13) and requested him to submit an updated report to the Sub-Commission at its forty-eighth session and to convene an expert seminar on the practice of forced eviction and its relationship to internationally recognized human rights.
١٢- أحاطت اللجنة الفرعية علما بقرارها ٥٩٩١/٩٢ المؤرخ في ٤٢ آب/أغسطس ٥٩٩١ بتقرير اﻷمين العام عن المبادئ التوجيهية بشأن اﻷحداث الدولية وعمليات اﻹخلاء القسري )E/CN.4/Sub.2/1995/13( ورجت منه أن يقدم تقريرا مستوفى إلى اللجنة الفرعية في دورتها الثامنة واﻷربعين وأن يعقد حلقة دراسية للخبراء بشأن ممارسة اﻹخلاء القسري وعلاقة هذه الممارسة بحقوق اﻹنسان المعترف بها دوليا.

The Commission on Human Rights has affirmed " that the practice of forced eviction constitutes a gross violation of human rights, in particular the right to adequate housing " .
وأكدت لجنة حقوق الإنسان " أن عمليات الإخلاء القسري تشكل انتهاكاً جسيماً لحقوق الإنسان، وخاصة الحق في السكن اللائق " (5).
