Expensive preselection documents may be used as an additional tool to limit the number of bidders.
وقد تستخدم وثائق باهظة الثمن للاختيار اﻷولي كوسيلة اضافية للحد من عدد مقدمي العروض .

This requirement is further elaborated in article 14 on the rules concerning the manner, place and deadline for presenting application to pre-qualify or applications for preselection or for presenting submissions.
ثم يُصاغ هذا الاشتراط بمزيد من التوسّع في المادة 14 عن القواعد الخاصة بطريقة تقديم طلب التأهّل الأوّلي أو طلبات الاختيار الأوّلي أو تقديم العروض، وكذلك مكان ذلك التقديم وموعده النهائي.

The provisions of article 17 of this Law shall apply mutatis mutandis to the preselection proceedings, except to the extent that those provisions are derogated from in this paragraph:
وتسري على إجراءات الاختيار الأولي أحكام المادة 17 من هذا القانون، مع ما يقتضيه اختلاف الحال من تغييرات، إلاّ إذا نصّت هذه الفقرة على تحلّل جزئي من تلك الأحكام:

Article 14. Rules concerning the manner, place and deadline for presenting applications to pre-qualify or applications for preselection or for presenting submissions
المادة 14- القواعد المتعلقة بطريقة ومكان تقديم طلبات التأهّل الأولي أو الطلبات بشأن الاختيار الأولي أو تقديم العروض والموعد النهائي لتقديمها

(a) The procuring entity shall specify in the preselection documents that it will request proposals only from a limited number of preselected suppliers or contractors that best meet the qualification criteria specified in the preselection documents;
(أ) تنصّ الجهة المشترية في وثائق الاختيار الأولي على أنها لن تطلب اقتراحات إلاّ من عدد محدود من المورِّدين أو المقاولين الذين يفون على أحسن وجه بمعايير التأهّل المحدّدة في وثائق الاختيار الأولي؛

11. Paragraph (4) requires all criteria and requirements as regards assessment of qualifications of suppliers or contractors to be set out in any pre-qualification or preselection document and in the solicitation documents.
11- وتشترط الفقرة (4) أن تُبيَّن جميع المعايير والاشتراطات فيما يخصّ تقييم مؤهّلات المورِّدين أو المقاولين في أيِّ وثيقة من وثائق التأهيل الأولي أو الاختيار الأولي وفي وثائق الالتماس.

In some jurisdictions, standard qualification requirements are found in procurement regulations, and the pre-qualification/preselection/solicitation documents may simply cross-refer to those regulations.
وفي بعض الولايات القضائية، تَرِد متطلّبات التأهيل المعيارية في لوائح الاشتراء، وقد تتضمّن وثائق التأهيل الأولي/الاختيار الأولي/الالتماس إحالات إلى تلك اللوائح فحسب.

1. The purpose of article 10 is to emphasize the importance of the principle of clarity, sufficient precision, completeness and objectivity in the description of the subject matter of procurement in any pre-qualification or preselection documents and in the solicitation documents.
1- الغرض من المادة 10 هو التأكيد على أهمية مبدأ الوضوح والدقة الكافية والكمال والموضوعية في وصف الشيء موضوع الاشتراء في أيِّ وثائق تتعلق بالتأهيل الأولي أو الاختيار الأولي وفي وثائق الالتماس.

The term " preselection " used in article 2 (b) (and elsewhere in the ML) is not defined. A definition should be considered.
وتعبير " الاختيار الأولي " ، المستخدم في المادة 2 (ب) وفي مواضع أخرى من القانون النموذجي، ليس معرَّفا، وينبغي النظر في وضع تعريف له.

Accordingly article 33 should contain a provision how the preselection should take place (especially ensuring transparency and non-discrimination).
ومن ثم، ينبغي أن تتضمن المادة 33 حكما بشأن كيفية إجراء الاختيار الأولي (بما يكفل، على وجه الخصوص، الشفافية وعدم التمييز).

4. In some jurisdictions, practices that require including in any pre-qualification or preselection documents and in the solicitation documents a reference source for technical terms used (such as the European Common Procurement Vocabulary) have proved to be useful.
4- وفي بعض الولايات القضائية، ثبتت فائدة الممارسات التي تشترط أن يُدرج في أيٍّ من وثائق التأهيل الأولي أو الاختيار الأولي وفي وثائق الالتماس المصدر المرجعي للمصطلحات التقنية المستخدمة (مثل معجم الاشتراء الموحّد الأوروبي).

Paragraph (2) deals with information from suppliers or contractors contained in applications to pre-qualify or for preselection, or in submissions.
4- وتتناول الفقرة (2) المعلومات الخاصة بالمورِّدين أو المقاولين الواردة في طلبات التأهل الأولي أو الاختيار الأولي أو في العروض.

The pool of suppliers or contractors under paragraph (3) is limited to those that presented submissions because suppliers or contractors that were disqualified as a result of pre-qualification or preselection should not have access to information relevant to the examination and evaluation of submissions.
6- وتقصر الفقرة (3) نطاق الإفصاح على مجموعة المورِّدين أو المقاولين الذين قدموا عروضاً لأنَّ المورِّدين أو المقاولين الذين تبين أنهم غير مؤهلين نتيجة للتأهيل الأولي أو الاختيار الأولي ينبغي ألا يتاح لهم الاطلاع على المعلومات المتعلقة بفحص العروض وتقييمها.

(5) Notice of any extension of the deadline shall be given promptly to each supplier or contractor to which the procuring entity provided the pre-qualification, preselection or solicitation documents.
(5) يُسارَع إلى توجيه إشعار بأيّ تمديد للموعد النهائي إلى كل مورِّد أو مقاول زودته الجهة المشترية بوثائق التأهيل الأولي أو بوثائق الاختيار الأولي أو بوثائق الالتماس.

(a) The procuring entity engages in pre-qualification proceedings in accordance with article 17 of this Law or in preselection proceedings in accordance with article 48 (3) of this Law; or
(أ) عندما تقوم الجهة المشترية بإجراءات التأهيل الأولي وفقا للمادة 17 من هذا القانون أو إجراءات الاختيار الأولي وفقا للمادة 48 (3) من هذا القانون؛

Quantitative preselection criteria are found to be more easily applicable and transparent than qualitative criteria involving the use of merit points.
وقد تبين أن المعايير الكمية للاختيار اﻷولي أيسر تطبيقا وأفضل شفافية من المعايير النوعية التي تقتضي استخدام نقاط جدارة .

(g) " preselection documents " means documents issued by the procuring entity under article 48 (3) of this Law that set out the terms and conditions of the preselection proceedings;

The method herein consists of a two stage procedure with a preselection phase.
وتتألف الطريقة الواردة هنا من اجراء ذي مرحلتين مع مرحلة اختيار أولي .

In traditional Government procurement, preselection proceedings may consist of the verification of certain formal requirements, such as adequate proof of technical capability or prior experience in the type of procurement, so that all bidders who meet the preselection criteria are automatically admitted to the tendering phase.
ففي الاشتراء الحكومي التقليدي ، قد تتألف اجراءات الاختيار اﻷولي من التحقق من الوفاء بشروط رسمية معينة ، مثل وجود البرهان الملائم على توافر القدرة التقنية أو الخبرة السابقة في نوع الاشتراء المطلوب ، بحيث يشارك تلقائيا في مرحلة تقديم العطاءات جميع مقدمي العروض الذين يستوفون معايير الاختيار اﻷولي .
