٣١- وينبغي للدول اﻷطراف أن تبين عند تقديم تقاريرها اﻷحكام الواردة في قانونها الجنائي التي تقضي بالمعاقبة على التعذيب والمعاملة أو العقوبة القاسية واللاإنسانية والمهينة، مع تحديد العقوبات التي تطبق على ارتكاب هذه اﻷفعال، سواء ارتكبها مسؤولون عموميون أو أشخاص آخرون يعملون باسم الدولة، أو أفراد بصفتهم الشخصية.
