Draft guideline 2.6.12 established the principle that an objection formulated prior to the expression of consent to be bound by a treaty did not need to be confirmed, unless the objecting party had not yet signed the treaty at the time.
وكرس مشروع المبدأ التوجيهي 2-6-12 المبدأ القاضي بأن إبداء اعتراض قبل التعبير عن الرضا بالالتزام بمعاهدة لا يتطلب التأكيد، إلا أن يكون الطرف المعترض غير موقع على المعاهدة في ذلك الوقت.

Not only is the idea of formulating an acceptance prior to the expression of consent to be bound by the treaty excluded by the very wording of article 20, paragraph 5, of the Vienna Conventions, which allows the formulation of acceptances only by contracting States or international organizations, but it is also difficult in practice to imagine that a State or international organization would actually formulate such an acceptance.

An objection formulated prior to the expression of consent to be bound by the treaty does not need to be formally confirmed by the objecting State or international organization at the time it expresses its consent to be bound if that State or that organization had signed the treaty when it had formulated the objection; it must be confirmed if the State or the international organization had not signed the treaty.

وهذا الاعتراض الذي يصاغ قبل الإعراب عن الموافقة على الالتزام بالمعاهدة يدفع بالتالي الدولة المتحفِظة إلى إعادة التفكير في تحفظها أو تعديله أو سحبه على غرار ما يحدث في حالة الاعتراض الذي تبديه دولة متعاقدة.
